1 A bill to be entitled
2 An act relating to manufactured buildings;
3 amending s. 553.36, F.S.; authorizing the use
4 of certain foundation systems for all types of
5 manufactured buildings; amending s. 553.37,
6 F.S.; authorizing the permitting for a
7 specified time of manufactured buildings that
8 use a foundation system designed and installed
9 in accordance with certain standards;
10 authorizing such use to be extended upon
11 application and inspection; prohibiting the
12 denial of such extension without an inspection
13 and verified findings of fault with the
14 foundation system; providing that the act does
15 not apply to residential manufactured buildings
16 or factory-built schools; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Subsection (12) of section 553.36, Florida
22 Statutes, is amended to read:
23 553.36 Definitions.--The definitions contained in this
24 section govern the construction of this part unless the
25 context otherwise requires.
26 (12) "Manufactured building" means a closed structure,
27 building assembly, or system of subassemblies, which may
28 include structural, electrical, plumbing, heating,
29 ventilating, or other service systems manufactured in
30 manufacturing facilities for installation or erection as a
31 finished building or as part of a finished building, which

1 shall include, but not be limited to, residential, commercial,
2 institutional, storage, and industrial structures. The term
3 includes buildings not intended for human habitation such as
4 lawn storage buildings and storage sheds manufactured and
5 assembled offsite by a manufacturer certified in conformance
6 with this part. This part does not apply to mobile homes. The
7 foundation systems set forth in rules 15C-1 and 15C-2, Florida
8 Administrative Code, are acceptable systems for all types of
9 manufactured buildings.
10 Section 2. Subsection (12) is added to 553.37, Florida
11 Statutes, to read:
12 553.37 Rules; inspections; and insignia.--
13 (12) A manufactured building that otherwise complies
14 with this part and that is intended to be used for 2 years or
15 less shall be permitted to use a foundation system designed
16 and installed in accordance with the standards adopted
17 pursuant to s. 320.8325(1). Use of the building shall be
18 extended for an additional 2 years upon application to the
19 authority having jurisdiction and an inspection of the
20 foundation system to determine its integrity and ability to
21 perform. An application for an extension may not be denied
22 without a complete inspection and verified findings of fault
23 with the foundation system. This subsection does not apply to
24 a residential manufactured building or factory-built school.
25 Section 3. This act shall take effect upon becoming a
26 law.

COMMITTEE SUBSTITUTE FOR

4 The CS provides that certain foundation systems currently
authorized for use in connection with mobile/manufactured
5 homes may be utilized for all types of manufactured buildings.
The CS also provides that manufactured buildings that are
6 intended to be used for 2 years or less must be permitted to
use a foundation system designed and installed in accordance
7 with s. 320.8325(1), F.S. Use of the building may be extended
for an additional two years upon application and inspection of
8 the foundation.
