  1                      A bill to be entitled

  2         An act relating to concealed weapons; amending

  3         s. 790.06, F.S.; providing that a licensee who

  4         is serving on active duty in any branch of the

  5         United States Armed Services and who is

  6         participating in the Global War on Terrorism on

  7         the date of the expiration of the license has

  8         an additional 180 days following the date the

  9         licensee returns to Florida in which to renew

10         his or her license to carry a concealed weapon

11         or a concealed firearm; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Subsection (11) of section 790.06, Florida

17  Statutes, is amended to read:

18         790.06  License to carry concealed weapon or firearm.--

19         (11)  No less than 90 days before prior to the

20  expiration date of the license, the Department of Agriculture

21  and Consumer Services shall mail to each licensee a written

22  notice of the expiration and a renewal form prescribed by the

23  Department of Agriculture and Consumer Services. The licensee

24  must renew his or her license on or before the expiration date

25  by filing with the Department of Agriculture and Consumer

26  Services the renewal form containing a notarized affidavit

27  stating that the licensee remains qualified pursuant to the

28  criteria specified in subsections (2) and (3), a color

29  photograph as specified in paragraph (5)(e), and the required

30  renewal fee. However, if a licensee is serving on active duty

31  in any branch of the United States Armed Services and is

 1  participating in the Global War on Terrorism on the date of

 2  the expiration of the license, the licensee has an additional

 3  180 days following the date the licensee returns to this state

 4  in which to renew his or her license to carry a concealed

 5  weapon or a concealed firearm. Out-of-state residents must

 6  also submit a completed fingerprint card and fingerprint

 7  processing fee. The license shall be renewed upon receipt of

 8  the completed renewal form, color photograph, appropriate

 9  payment of fees, and, if applicable, a completed fingerprint

10  card. Additionally, a licensee who fails to file a renewal

11  application on or before its expiration date must renew his or

12  her license by paying a late fee of $15. A No license may not

13  shall be renewed 6 months or more after its expiration date,

14  and this such license is shall be deemed to be permanently

15  expired. A person whose license has been permanently expired

16  may reapply for licensure; however, an application for

17  licensure and fees under pursuant to subsection (5) must be

18  submitted, and a background investigation shall be conducted

19  pursuant to the provisions of this section. A person Persons

20  who knowingly files file false information under pursuant to

21  this subsection is shall be subject to criminal prosecution

22  under s. 837.06.

23         Section 2.  This act shall take effect July 1, 2006.

28  The CS extends the length of time specified military personnel
    have to review their concealed weapons license from 90 to 180
29  days. The CS also replaces the reference to military personnel
    serving on active duty in "Operation Enduring Freedom or
30  Operation Iraqi Freedom," to military personnel participating
    in the "Global War on Terrorism."
