1 A bill to be entitled
2 An act relating to concealed weapons; amending
3 s. 790.06, F.S.; revising provisions concerning
4 licenses for concealed weapons or concealed
5 firearms held by a servicemember; prohibiting
6 license expiration while the servicemember is
7 under military orders to be a certain distance
8 away from his or her residence; providing for
9 an extension of the time to renew such a
10 license; providing for fees and costs when such
11 a license is renewed within the extension
12 period; providing criteria to qualify for such
13 extension; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Subsection (11) of section 790.06, Florida
18 Statutes, is amended to read:
19 790.06 License to carry concealed weapon or firearm.--
20 (11)(a) No less than 90 days before prior to the
21 expiration date of the license, the Department of Agriculture
22 and Consumer Services shall mail to each licensee a written
23 notice of the expiration and a renewal form prescribed by the
24 Department of Agriculture and Consumer Services. The licensee
25 must renew his or her license on or before the expiration date
26 by filing with the Department of Agriculture and Consumer
27 Services the renewal form containing a notarized affidavit
28 stating that the licensee remains qualified pursuant to the
29 criteria specified in subsections (2) and (3), a color
30 photograph as specified in paragraph (5)(e), and the required
31 renewal fee. Out-of-state residents must also submit a

1 completed fingerprint card and fingerprint processing fee. The
2 license shall be renewed upon receipt of the completed renewal
3 form, color photograph, appropriate payment of fees, and, if
4 applicable, a completed fingerprint card. Additionally, a
5 licensee who fails to file a renewal application on or before
6 its expiration date must renew his or her license by paying a
7 late fee of $15. A No license may not shall be renewed 180
8 days 6 months or more after its expiration date, and such a
9 license is shall be deemed to be permanently expired. A person
10 whose license has been permanently expired may reapply for
11 licensure; however, an application for licensure and fees
12 under pursuant to subsection (5) must be submitted, and a
13 background investigation shall be conducted pursuant to the
14 provisions of this section. A person Persons who knowingly
15 files file false information under pursuant to this subsection
16 is shall be subject to criminal prosecution under s. 837.06.
17 (b) A license issued to a servicemember, as defined in
18 s. 250.01, is subject to paragraph (a); however, such a
19 license does not expire while the servicemember is serving on
20 military orders that have taken him or her over 35 miles from
21 his or her residence and shall be extended, as provided in
22 this paragraph, for up to 180 days after his or her return to
23 such residence. If the license-renewal requirements in
24 paragraph (a) are met within the 180-day extension period, the
25 servicemember may not be charged any additional costs, such
26 as, but not limited to, late fees or delinquency fees, above
27 the normal license fees. The servicemember must present to the
28 Department of Agriculture and Consumer Services a copy of his
29 or her official military orders or a written verification from
30 the member's commanding officer before the end of the 180-day
31 period in order to qualify for the extension.
