A bill to be entitled
2An act relating to certification of swimming instructors;
3creating s. 514.072, F.S.; requiring additional
4certification of swimming instructors for people who have
5developmental disabilities; providing a remedy for
6certification violations; providing an appropriation;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 514.072, Florida Statutes, is created
12to read:
13     514.072  Certification of swimming instructors for people
14who have developmental disabilities required.--
15     (1)  Any person working at a public swimming pool as a
16swimming instructor for people who have developmental
17disabilities, as defined in s. 393.063(10), must be certified by
18the Dan Marino Foundation, Inc., in addition to being certified
19under s. 514.071. A person certified under s. 514.071 before
20July 1, 2006, must meet the additional certification
21requirements of this section by January 1, 2007. A person
22certified under s. 514.071 on or after July 1, 2006, must meet
23the additional certification requirements of this section within
246 months after receiving certification under s. 514.071.
25     (2)  In addition to any other remedies available to the
26department, the department may sue to enjoin the operation of
27any public swimming pool that uses any swimming instructor in
28violation of subsection (1).
29     Section 2.  The sum of $535,000 is appropriated from the
30General Revenue Fund to the Department of Health for the 2006-
312007 fiscal year for the purpose of implementing this act, to be
32distributed as follows: $185,000 in recurring revenue to the Dan
33Marino Foundation, Inc., for swimming certification; $150,000 in
34nonrecurring revenue to Broward County Parks and Recreation for
35the SWIM Central Special Needs Certification, and $200,000 in
36nonrecurring revenue to the Weston YMCA for special needs
37modifications and enhancement for the developmentally disabled.
38     Section 3.  This act shall take effect July 1, 2006.
