6An act relating to certification of swimming instructors;
7creating s. 514.072, F.S.; requiring additional
8certification of swimming instructors for people who have
9developmental disabilities; requiring the Dan Marino
10Foundation, Inc., to develop certification requirements
11and a training curriculum and to submit the certification
12requirements to the Department of Health for review;
13providing deadlines for certification; providing a remedy
14for certification violations; providing an appropriation;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Section 514.072, Florida Statutes, is created
20to read:
21     514.072  Certification of swimming instructors for people
22who have developmental disabilities required.--
23     (1)  Any person working at a public swimming pool as a
24swimming instructor for people who have developmental
25disabilities, as defined in s. 393.063(10), must be certified by
26the Dan Marino Foundation, Inc., in addition to being certified
27under s. 514.071. The Dan Marino Foundation, Inc., must develop
28certification requirements and a training curriculum for
29swimming instructors for people who have developmental
30disabilities and must submit the certification requirements to
31the Department of Health for review by January 1, 2007. A person
32certified under s. 514.071 before July 1, 2007, must meet the
33additional certification requirements of this section before
34January 1, 2008. A person certified under s. 514.071 on or after
35July 1, 2007, must meet the additional certification
36requirements of this section within 6 months after receiving
37certification under s. 514.071.
38     (2)  In addition to any other remedies available to the
39department, the department may sue to enjoin the operation of
40any public swimming pool that uses any swimming instructor in
41violation of subsection (1).
42     Section 2.  The sum of $535,000, of which $185,000 is
43recurring, is appropriated from the General Revenue Fund to the
44Department of Health for distribution to the Dan Marino
45Foundation, Inc., for the 2006-2007 fiscal year for the purpose
46of implementing this act.
47     Section 3.  This act shall take effect July 1, 2006.
