6An act relating to certification of swimming instructors;
7creating s. 514.072, F.S.; requiring additional
8certification of swimming instructors specializing in
9training people who have developmental disabilities;
10requiring the Dan Marino Foundation, Inc., to develop
11certification requirements and a training curriculum and
12to submit the certification requirements to the Department
13of Health for review; providing deadlines for
14certification; providing a remedy for certification
15violations; providing an appropriation; providing an
16effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Section 514.072, Florida Statutes, is created
21to read:
22     514.072  Certification of swimming instructors for people
23who have developmental disabilities required.--
24     (1)  Any person working at a swimming pool who holds
25himself or herself out as a swimming instructor specializing in
26training people who have developmental disabilities, as defined
27in s. 393.063(10), must be certified by the Dan Marino
28Foundation, Inc., in addition to being certified under s.
29514.071. The Dan Marino Foundation, Inc., must develop
30certification requirements and a training curriculum for
31swimming instructors for people who have developmental
32disabilities and must submit the certification requirements to
33the Department of Health for review by January 1, 2007. A person
34certified under s. 514.071 before July 1, 2007, must meet the
35additional certification requirements of this section before
36January 1, 2008. A person certified under s. 514.071 on or after
37July 1, 2007, must meet the additional certification
38requirements of this section within 6 months after receiving
39certification under s. 514.071.
40     (2)  In addition to any other remedies available to the
41department, the department may sue to enjoin the operation of
42any public swimming pool that uses any swimming instructor in
43violation of subsection (1).
44     Section 2.  The sum of $535,000, of which $185,000 is
45recurring, is appropriated from the General Revenue Fund to the
46Department of Health for distribution to the Dan Marino
47Foundation, Inc., for the 2006-2007 fiscal year for the purpose
48of implementing this act.
49     Section 3.  This act shall take effect July 1, 2006.
