18 | Be It Enacted by the Legislature of the State of Florida: |
19 |

20 | Section 1. Section 514.072, Florida Statutes, is created |
21 | to read: |
22 | 514.072 Certification of swimming instructors for people |
23 | who have developmental disabilities required.--Any person |
24 | working at a swimming pool who holds himself or herself out as a |
25 | swimming instructor specializing in training people who have |
26 | developmental disabilities, as defined in s. 393.063(10), may be |
27 | certified by the Dan Marino Foundation, Inc., in addition to |
28 | being certified under s. 514.071. The Dan Marino Foundation, |
29 | Inc., must develop certification requirements and a training |
30 | curriculum for swimming instructors for people who have |
31 | developmental disabilities and must submit the certification |
32 | requirements to the Department of Health for review by January |
33 | 1, 2007. A person certified under s. 514.071 before July 1, |
34 | 2007, must meet the additional certification requirements of |
35 | this section before January 1, 2008. A person certified under s. |
36 | 514.071 on or after July 1, 2007, must meet the additional |
37 | certification requirements of this section within 6 months after |
38 | receiving certification under s. 514.071. |
39 | Section 2. Section 514.075, Florida Statutes, is amended |
40 | to read: |
41 | 514.075 Public pool service technician; |
42 | certification.--The department may require that a public pool, |
43 | as defined in s. 514.011, be serviced by a person certified as a |
44 | pool service technician. To be certified, an individual must |
45 | demonstrate knowledge of public pools which includes, but is not |
46 | limited to: pool cleaning; general pool maintenance; source of |
47 | the water supply; bacteriological, chemical, and physical |
48 | quality of water; and water purification, testing, treatment, |
49 | and disinfection procedures. The department may, by rule, |
50 | establish the requirement for the certification course and |
51 | course approval. The department shall deem certified any |
52 | individual who is certified by a course of national recognition |
53 | or any person licensed under s. 489.105(3)(j), (k), or (l). This |
54 | requirement does not apply to a person, or the direct employee |
55 | of a person, permitted as a public pool operator under s. |
56 | 514.031. |
57 | Section 3. This act shall take effect July 1, 2006, only |
58 | if a specific appropriation to the Department of Health to fund |
59 | the Dan Marino Foundation, Inc., is made in the General |
60 | Appropriations Act for fiscal year 2006-2007. |
