A bill to be entitled
2An act relating to swimming instructors; creating s.
3514.072, F.S.; requiring additional certification of
4swimming instructors specializing in training people who
5have developmental disabilities; requiring the Dan Marino
6Foundation, Inc., to develop certification requirements
7and a training curriculum and to submit the certification
8requirements to the Department of Health for review;
9providing deadlines for certification; providing a
10contingent effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 514.072, Florida Statutes, is created
15to read:
16     514.072  Certification of swimming instructors for people
17who have developmental disabilities required.--Any person
18working at a swimming pool who holds himself or herself out as a
19swimming instructor specializing in training people who have
20developmental disabilities, as defined in s. 393.063(10), may be
21certified by the Dan Marino Foundation, Inc., in addition to
22being certified under s. 514.071. The Dan Marino Foundation,
23Inc., must develop certification requirements and a training
24curriculum for swimming instructors for people who have
25developmental disabilities and must submit the certification
26requirements to the Department of Health for review by January
271, 2007. A person certified under s. 514.071 before July 1,
282007, must meet the additional certification requirements of
29this section before January 1, 2008. A person certified under s.
30514.071 on or after July 1, 2007, must meet the additional
31certification requirements of this section within 6 months after
32receiving certification under s. 514.071.
33     Section 2.  This act shall take effect July 1, 2006, only
34if a specific appropriation to the Department of Health to fund
35the Dan Marino Foundation, Inc., is made in the General
36Appropriations Act for fiscal year 2006-2007.
