6 | Section 3. Section 627.4107, Florida Statutes, is created |
7 | to read: |
8 | 627.4107 Government employees exposed to toxic drug |
9 | chemicals; cancellation of life or health policy or certificate |
10 | prohibited.--No life or health insurer may cancel or nonrenew a |
11 | life or health insurance policy or certificate of insurance |
12 | providing coverage to a state or local law enforcement officer |
13 | as defined in s. 943.10, firefighter as defined in s. 633.30, |
14 | emergency medical technician as defined in s. 401.23, or |
15 | paramedic as defined in s. 401.23, a volunteer firefighter |
16 | engaged by state or local government, a law enforcement officer |
17 | employed by the Federal Government, or any other local, state, |
18 | or Federal Government employee solely based on the fact that the |
19 | individual has been exposed to toxic chemicals or suffered |
20 | injury or disease as a result of the individual's lawful duties |
21 | arising out of the commission of a violation of chapter 893 by |
22 | another person. This section does not apply to any person who |
23 | commits an offense under chapter 893. This section does not |
24 | prohibit an insurer from canceling or nonrenewing an insurance |
25 | policy or certificate, as permitted under the applicable state |
26 | insurance code, based on an act or practice of the policyholder |
27 | or certificateholder that constitutes fraud or intentional |
28 | misrepresentation of material fact by the policyholder or |
29 | certificateholder. |
30 | Section 4. Paragraph (a) of subsection (4) of section |
31 | 907.041, Florida Statutes, is amended, and paragraph (l) is |
32 | added to that subsection, to read: |
33 | 907.041 Pretrial detention and release.-- |
34 | (4) PRETRIAL DETENTION.-- |
35 | (a) As used in this subsection, "dangerous crime" means |
36 | any of the following: |
37 | 1. Arson; |
38 | 2. Aggravated assault; |
39 | 3. Aggravated battery; |
40 | 4. Illegal use of explosives; |
41 | 5. Child abuse or aggravated child abuse; |
42 | 6. Abuse of an elderly person or disabled adult, or |
43 | aggravated abuse of an elderly person or disabled adult; |
44 | 7. Aircraft piracy; |
45 | 8. Kidnapping; |
46 | 9. Homicide; |
47 | 10. Manslaughter; |
48 | 11. Sexual battery; |
49 | 12. Robbery; |
50 | 13. Carjacking; |
51 | 14. Lewd, lascivious, or indecent assault or act upon or |
52 | in presence of a child under the age of 16 years; |
53 | 15. Sexual activity with a child, who is 12 years of age |
54 | or older but less than 18 years of age, by or at solicitation of |
55 | person in familial or custodial authority; |
56 | 16. Burglary of a dwelling; |
57 | 17. Stalking and aggravated stalking; |
58 | 18. Act of domestic violence as defined in s. 741.28; |
59 | 19. Home invasion robbery; |
60 | 20. Act of terrorism as defined in s. 775.30; and |
61 | 21. Manufacturing any substances in violation of chapter |
62 | 893; and |
63 | 22.21. Attempting or conspiring to commit any such crime. |
64 | (l) The Legislature finds that a person who manufactures |
65 | any substances in violation of chapter 893 poses a threat of |
66 | harm to the community and that the factual circumstances of such |
67 | a crime indicate a disregard for the safety of the community. |
68 | The court shall order pretrial detention if the court finds that |
69 | there is a substantial probability that a defendant charged with |
70 | manufacturing any substances in violation of chapter 893 |
71 | committed such a crime and if the court finds that there are no |
72 | conditions of release reasonably sufficient to protect the |
73 | community from the risk of physical harm to persons. |
