11 Senator Fasano moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 20, between lines 5 and 6,

16 insert:
17 Section 6. For the purpose of protecting and ensuring
18 the safety and security of the data held by the Agency for
19 Health Care Administration, as described in s. 408.061,
20 Florida Statutes, the agency shall be responsible for ensuring
21 that the data and data backup systems are housed at a secure
22 facility that meets or exceeds the following requirements:
23 (1) The facility must be located in the state;
24 (2) The facility must be designated as a critical
25 facility by the county emergency management agency, under s.
26 252.38, Florida Statutes, in the county where the facility is
27 located;
28 (3) The facility must be designed to withstand a
29 category 5 hurricane and be outside the 500-year flood zone
30 established by the Federal Emergency Management Agency;
31 (4) The facility must have six or more tier-one

1 telecommunication carriers deployed at the facility;
2 (5) The facility must have commercial power supplied
3 by at least two separate substation feeders and must be able
4 to operate continuously for at least 5 days on its own power
5 generation system without refueling if such commercial power
6 is interrupted; and
7 (6) The facility must have successfully undergone a
8 Statement on Auditing Standards (SAS) No. 70 review,
9 representing that the facility has been through an in-depth
10 review of the security and information technology control
11 process relating to its operation.
