1 A bill to be entitled
2 An act relating to the Florida Building Code;
3 authorizing the Florida Building Commission to
4 amend wind-design standards in the code;
5 expressly superseding a provision; providing an
6 effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Notwithstanding subsection (3) of section
11 109 of chapter 2000-141, Laws of Florida, the Florida Building
12 Commission may update or modify the wind-design standard
13 applicable to construction in this state as adopted within the
14 Florida Building Code in accordance with the requirements of
15 s. 553.73, Florida Statutes. The Florida Building Commission
16 is specifically authorized to identify within the Florida
17 Building Code those areas of the state from the eastern border
18 of Franklin County west to the Florida-Alabama line which are
19 subject to the windborne-debris requirements of the code. The
20 Florida Building Commission's initial designation of wind
21 lines for this region shall address the results of the study
22 required by section 39 of chapter 2005-147, Laws of Florida.
23 The initial designation of those areas after July 1, 2006, is
24 subject to only the rule-adoption procedures of chapter 120,
25 Florida Statutes, notwithstanding the code-development
26 procedures of chapter 553, Florida Statutes. This section
27 shall not take effect for 6 months following the completion of
28 rulemaking or May 31, 2007, whichever occurs sooner. The
29 provisions of subsection (3) of section 109 of chapter
30 2000-141, Laws of Florida, are expressly superseded.
31 Section 2. This act shall take effect July 1, 2006.

4 The CS specifically authorizes the Florida Building Commission
to identify within the Florida Building Code those areas of
5 the state from the eastern border of Franklin County to the
Florida/Alabama line which are subject to the windborne debris
6 requirements of the code. The Commission's initial designation
of windlines for the Panhandle region must address the
7 findings of the Florida Panhandle Windborne Debris study and
is only subject to the rule adoption procedures of ch. 120,
8 F.S., notwithstanding the code-development procedures of ch.
553, F.S. This provision shall not take effect for 6 months
9 following the completion of rulemaking or May 31, 2007,
whichever occurs sooner.
