2 An act relating to the Florida Building Code;
3 authorizing the Florida Building Commission to
4 amend wind-design standards in the code;
5 expressly superseding a provision; amending s.
6 553.841, F.S.; providing for funding for
7 building code education; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. The Florida Building Commission may update
13 or modify the wind-design standard applicable to construction
14 in this state as adopted within the Florida Building Code in
15 accordance with the requirements of s. 553.73, Florida
16 Statutes. The Florida Building Commission is specifically
17 authorized to identify within the Florida Building Code those
18 areas of the state from the eastern border of Franklin County
19 west to the Florida-Alabama line which are subject to the
20 windborne-debris requirements of the code. The Florida
21 Building Commission's initial designation of wind lines for
22 this region shall address the results of the study required by
23 section 39 of chapter 2005-147, Laws of Florida. The initial
24 designation of those areas after July 1, 2006, is subject to
25 only the rule-adoption procedures of chapter 120, Florida
26 Statutes, notwithstanding the code-development procedures of
27 chapter 553, Florida Statutes. The rules adopted pursuant to
28 this section shall not take effect for 6 months following the
29 adoption of the rules or May 31, 2007, whichever occurs
30 sooner. The provisions of subsection (3) of section 109 of
31 chapter 2000-141, Laws of Florida, are expressly superseded.

1 Section 2. Subsection (5) of section 553.841, Florida
2 Statutes, is amended to read:
3 553.841 Building code education and outreach
4 program.--
5 (5) The Building Code Education and Outreach Council
6 shall:
7 (a) Recommend to the commission Consider and determine
8 any policies or procedures needed to administer ss. 489.109(3)
9 and 489.509(3). The commission shall direct the expenditure of
10 funds derived from ss. 489.109(3) and 489.509(3) for building
11 code education.
12 (b) Administer the provisions of this section.
13 (c) Determine the areas of priority for which funds
14 should be expended for education and outreach.
15 (d) Review all proposed subjects for advanced courses
16 concerning the Florida Building Code and recommend to the
17 commission any related subjects that should be approved for
18 advanced courses.
19 Section 3. This act shall take effect July 1, 2006.

4 The committee substitute clarifies that the rules adopted by
the Florida Building Commission will not take effect until 6
5 months after their adoption or March 31, 2007 whichever is
sooner.

It eliminates redundant language regarding the repeal of the
7 provisions of subsection (3) of s. 109 of chapter 2000-141,
L.O.F.

The committee substitute amends s. 553.841, F.S., to provide
9 that the Building Code Education and Outreach Council
recommend to the Florida Building Commission any policies or
10 procedures needed to administer s. 489.109(3), F.S., and s.
489.509(3), F.S.

It amends s. 553.841, F.S., to authorize the Florida Building
12 Commission to direct the expenditure of funds derived from s.
489.109(3), F.S., and s. 489(3), F.S., for building code
13 education.
