11 The Committee on Judiciary (Aronberg) recommended the
12 following substitute for amendment (614502):

14 Senate Amendment (with title amendment)
15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 770.09, Florida Statutes, is
19 created to read:
20 770.09 Publicity placing a person in a false light.--A
21 person who gives publicity to a matter concerning another
22 person which places the other person before the public in a
23 false light is subject to liability to the other person for
24 invasion of his or her privacy, if:
25 (1) The false light in which the other person was
26 placed would be highly offensive to a reasonable person; and
27 (2) The actor had knowledge of or acted in reckless
28 disregard as to the falsity of the publicized matter and the
29 false light in which the other person would be placed.
30 Section 2. Paragraph (h) is added to subsection (4) of
31 section 95.11, Florida Statutes, to read:

1 95.11 Limitations other than for the recovery of real
2 property.--Actions other than for recovery of real property
3 shall be commenced as follows:
4 (4) WITHIN TWO YEARS.--
5 (h) An action for publicity placing a person in a
6 false light pursuant to s. 770.09.
7 Section 3. This act shall take effect July 1, 2006.

15 A bill to be entitled
16 An act relating to actions involving free
17 speech or defamation; creating s. 770.09, F.S.;
18 providing criteria for liability for invasion
19 of privacy for giving publicity to a matter
20 that places a person before the public in a
21 false light; amending s. 95.11, F.S.; limiting
22 the period in which to commence an action;
23 providing an effective date.
