  1                      A bill to be entitled

  2         An act relating to nursing services; amending

  3         s. 395.0191, F.S.; requiring hospitals to meet

  4         the requirements of a federal regulation

  5         relating to registered nurses performing

  6         circulating duties in operating rooms;

  7         requiring circulating nurses to be present in

  8         operating rooms during specified times;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Paragraph (d) is added to subsection (2) of

14  section 395.0191, Florida Statutes, to read:

15         395.0191  Staff membership and clinical privileges.--

16         (2)

17         (d)  Each hospital must meet the requirements of the

18  Medicare and Medicaid Conditions of Participation for

19  Hospitals under 42 C.F.R. s. 482.51(a)(3) as they apply to

20  registered nurses performing circulating duties in the

21  operating room and as provided in the interpretive guidelines

22  provided by the United States Department of Health and Human

23  Services. A circulating nurse must be present in the operating

24  room for the duration of a surgical procedure.

25         Section 2.  This act shall take effect July 1, 2006.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1362

 4  The committee substitute requires that each hospital must meet
    the requirements under 42 C.F.R. s. 482.51(a)(3) and the
 5  interpretive guidelines regarding nurses performing
    circulating duties in the operating room. A circulating nurse
 6  must be present in the operating room for the duration of a
    surgical procedure.
