15         On page 49, before line 1,

17  insert:  
18         Section 26.  Section 723.083, Florida Statutes, is
19  amended to read:
20         723.083  Governmental action affecting removal of
21  mobile home owners.--
22         (1)  No agency of municipal, local, county, or state
23  government shall approve any application for rezoning, or take
24  any other official action, which would result in the removal
25  or relocation of mobile home owners residing in a mobile home
26  park without first determining that adequate mobile home parks
27  or other suitable facilities exist for the relocation of the
28  mobile home owners.
29         (2)  Upon a finding that adequate mobile home parks or
30  other suitable facilities exist for the relocation of mobile
31  home owners, and pursuant to the subsequent rezoning or other

Barcode 571902 1 official action which results in the removal or relocation of 2 mobile home owners, one-fifth of the increase in county or 3 municipal ad valorem property taxes levied, exclusive of any 4 amount from any debt service millage, created as a result of 5 the development of the land previously occupied by the mobile 6 home park must be transferred to the Mobile Home Relocation 7 Trust Fund established in s. 723.06115, for a period of 5 8 years. The amount to be transferred shall be determined 9 annually and shall be that amount equal to one-fifth of 95 10 percent of the difference between: 11 (a) The amount of county and municipal ad valorem 12 taxes levied each year, exclusive of any amount from any debt 13 service millage, on the parcel or parcels of property formerly 14 occupied by the mobile home park; and 15 (b) The amount of county and municipal ad valorem 16 taxes levied, exclusive of any amount from any debt service 17 millage, on the parcel or parcels of property occupied by the 18 mobile home park in the last year such park operated as a 19 mobile home park. 20 21 The first transfer must be made by January 1 of the second 22 year following the substantial completion of the new 23 development.
