  1                      A bill to be entitled

  2         An act relating to traffic regulations;

  3         amending s. 316.003, F.S.; redefining the term

  4         "golf cart"; amending s. 316.1303, F.S.;

  5         requiring that drivers yield to a disabled

  6         person operating a golf cart; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (68) of section 316.003, Florida

12  Statutes, is amended to read:

13         316.003  Definitions.--The following words and phrases,

14  when used in this chapter, shall have the meanings

15  respectively ascribed to them in this section, except where

16  the context otherwise requires:

17         (68)  GOLF CART.--A motor vehicle designed and

18  manufactured for operation on a golf course for sporting or

19  recreational purposes or to transport persons who are issued a

20  disabled parking permit under s. 320.0848.

21         Section 2.  Section 316.1303, Florida Statutes, is

22  amended to read:

23         316.1303  Traffic regulations to assist

24  mobility-impaired persons.--Whenever a pedestrian is in the

25  process of crossing a public street or highway and the

26  pedestrian is mobility-impaired and (using a guide dog or

27  service animal designated as such with a visible means of

28  identification, a walker, a crutch, an orthopedic cane, or a

29  wheelchair), or whenever a person is operating a golf cart

30  that displays a disabled parking permit issued under s.

31  320.0848 and is in the process of crossing a public street or

 1  highway, the driver of every vehicle approaching the

 2  intersection, as defined in s. 316.003(17), shall bring his or

 3  her vehicle to a full stop before arriving at such

 4  intersection and, before proceeding, shall take such

 5  precautions as may be necessary to avoid injuring such

 6  pedestrian or golf cart operator. A person who is convicted of

 7  a violation of this section shall be punished as provided in

 8  s. 318.18(3).

 9         Section 3.  This act shall take effect July 1, 2006.
