7 | Be It Enacted by the Legislature of the State of Florida: |

9 | Section 1. (1)(a) The Legislature finds that the use of |
10 | estimates of prior year expenditures to establish maximum annual |
11 | budgets for the 2004-2005 county fiscal year resulted in maximum |
12 | annual budgets for some clerks of court which were less than the |
13 | amounts they would have been if actual prior-year expenditures |
14 | had been used. |
15 | (b) The Legislature further finds that the clerks of court |
16 | perform duties critical to the operation of the judicial branch |
17 | and that future maximum annual budgets for the clerks of court |
18 | are based in part on their prior-year budgets. |
19 | (c) The Legislature further finds that the difference |
20 | between establishing the maximum annual budget using estimated |
21 | prior-year expenditures and using actual prior-year expenditures |
22 | is significant for the Clerk of the Circuit Court, Hillsborough |
23 | County. |
24 | (d) The Legislature further finds that basing, in part, |
25 | future maximum annual budgets for the clerks of court on their |
26 | prior-year budgets does not allow a clerk of court to take into |
27 | account the costs resulting from independent pay and |
28 | classification studies resulting from civil service action. The |
29 | difference in expenditures between the approved maximum annual |
30 | budget expenditures and the increase in fixed costs that |
31 | resulted from a civil service study of positions and salaries |
32 | was significant for the Clerk of the Circuit Court, Hillsborough |
33 | County. |
34 | (2) Therefore, the maximum annual budget for the Clerk of |
35 | the Circuit Court, Hillsborough County, is increased by $269,378 |
36 | based upon the findings in paragraph (1)(c) and $639,000 based |
37 | upon the findings in paragraph (1)(d) for the 2004-2005 county |
38 | fiscal year and all county fiscal years thereafter. |
39 | Section 2. This act shall take effect upon becoming a law. |
