A bill to be entitled
2An act relating to the state judicial system; revising the
3maximum annual budget amount for the Clerk of the Circuit
4Court, Hillsborough County; providing retroactive
5applicability; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  (1)(a)  The Legislature finds that the use of
10estimates of prior year expenditures to establish maximum annual
11budgets for the 2004-2005 county fiscal year resulted in maximum
12annual budgets for some clerks of court which were less than the
13amounts they would have been if actual prior-year expenditures
14had been used.
15     (b)  The Legislature further finds that the clerks of court
16perform duties critical to the operation of the judicial branch
17and that future maximum annual budgets for the clerks of court
18are based in part on their prior-year budgets.
19     (c)  The Legislature further finds that the difference
20between establishing the maximum annual budget using estimated
21prior-year expenditures and using actual prior-year expenditures
22is significant for the Clerk of the Circuit Court, Hillsborough
23County.
24     (d)  The Legislature further finds that basing, in part,
25future maximum annual budgets for the clerks of court on their
26prior-year budgets does not allow a clerk of court to take into
27account the costs resulting from independent pay and
28classification studies resulting from civil service action. The
29difference in expenditures between the approved maximum annual
30budget expenditures and the increase in fixed costs that
31resulted from a civil service study of positions and salaries
32was significant for the Clerk of the Circuit Court, Hillsborough
33County.
34     (2)  Therefore, the maximum annual budget for the Clerk of
35the Circuit Court, Hillsborough County, is increased by $269,378
36based upon the findings in paragraph (1)(c) and $639,000 based
37upon the findings in paragraph (1)(d) for the 2004-2005 county
38fiscal year and all county fiscal years thereafter.
39     Section 2.  This act shall take effect upon becoming a law.
