2 An act relating to retirement benefits;
3 amending s. 112.0801, F.S.; providing a
4 definition of the term "retiree" for purposes
5 of determining when retired employees of county
6 constitutional officers are eligible to
7 participate in group insurance; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 112.0801, Florida Statutes, is
13 amended to read:
14 112.0801 Group insurance; participation by retired
15 employees.--
16 (1) Any state agency, county, municipality, special
17 district, community college, or district school board that
18 which provides life, health, accident, hospitalization, or
19 annuity insurance, or all of any kinds of such insurance, for
20 its officers and employees and their dependents upon a group
21 insurance plan or self-insurance plan shall allow all former
22 personnel who have retired prior to October 1, 1987, as well
23 as those who retire on or after such date, and their eligible
24 dependents, the option of continuing to participate in such
25 group insurance plan or self-insurance plan. Retirees and
26 their eligible dependents shall be offered the same health and
27 hospitalization insurance coverage as is offered to active
28 employees at a premium cost of no more than the premium cost
29 applicable to active employees. For the retired employees and
30 their eligible dependents, the cost of any such continued
31 participation in any type of plan or any of the cost thereof

1 may be paid by the employer or by the retired employees. To
2 determine health and hospitalization plan costs, the employer
3 shall commingle the claims experience of the retiree group
4 with the claims experience of the active employees; and, for
5 other types of coverage, the employer may commingle the claims
6 experience of the retiree group with the claims experience of
7 active employees. Retirees covered under Medicare may be
8 experience-rated separately from the retirees not covered by
9 Medicare and from active employees, provided that the total
10 premium does not exceed that of the active group and coverage
11 is basically the same as for the active group.
12 (2) With regard to employees of county constitutional
13 officers, for the purpose of determining eligibility to
14 participate in group insurance under this section, the term
15 "retiree" means an employee of a county constitutional officer
16 who has attained his or her normal retirement date and retired
17 under the system, who was insured under the employer's group
18 health insurance plan at the time of retirement, and who
19 immediately began receiving retirement benefits upon
20 retirement. An employee who does not elect to continue
21 coverage as provided in this section or who terminates
22 coverage is not eligible to reenter the employer's group
23 health plan at a later date unless subsequently reemployed by
24 the employer.
25 Section 2. This act shall take effect October 1, 2006.
