  1                      A bill to be entitled

  2         An act relating to reckless driving; amending

  3         s. 316.192, F.S.; revising the acts that

  4         constitute reckless driving; specifying certain

  5         acts that constitute reckless driving per se;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (1) of section 316.192, Florida

11  Statutes, is amended to read:

12         316.192  Reckless driving.--

13         (1)(a)  Any person who drives any vehicle in willful or

14  wanton disregard for the safety of persons or property, or at

15  a speed or in a manner that is likely to endanger any person

16  or property, is guilty of reckless driving.

17         (b)  The following acts constitute reckless driving per

18  se:

19         1.  Driving 20 miles per hour or more in excess of the

20  posted speed limit or 90 miles per hour or more regardless of

21  the posted speed limit; or

22         2.  Fleeing a law enforcement officer.

23         Section 2.  This act shall take effect July 1, 2006.

26                          SENATE SUMMARY

27    Provides that specific acts of speeding constitute
      reckless driving. Establishes certain acts as reckless
28    driving per se. (See bill for details.)
