A bill to be entitled
2An act relating to the Pal-Mar Water Control District,
3Palm Beach and Martin Counties; providing for dissolution
4of the district; repealing chapter 2005-307, Laws of
5Florida; providing for allocation of assets and
6liabilities of the district; providing for a referendum;
7providing resolution in the event of statutory conflict;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Pursuant to sections 189.4042(2) and
13189.4045(2), Florida Statutes, the Pal-Mar Water Control
14District is hereby dissolved, subject to the requirements stated
15in this act.
16     Section 2.  Chapter 2005-307, Laws of Florida, is repealed.
17     Section 3.  Title to all real property owned by the Pal-Mar
18Water Control District is transferred as of September 30, 2006,
19to Palm Beach County or Martin County, according to
20jurisdictional location.
21     Section 4.  All other assets or personal property and
22liabilities or indebtedness of the Pal-Mar Water Control
23District are transferred as of September 30, 2006, to Palm Beach
24County or Martin County, pursuant to an interlocal agreement to
25be executed among Palm Beach County, Martin County, the South
26Florida Water Management District, and any other appropriate
27governmental agency. The interlocal agreement shall ensure that
28any transferred funds are used to support ongoing maintenance or
29land acquisition for water quality or water quantity within the
30Pal-Mar Water Control District.
31     Section 5.  Prior to September 30, 2006, a landowner
32referendum shall be held by the board of supervisors of the Pal-
33Mar Water Control District on the question of whether the
34district should be dissolved. All landowners within the district
35are entitled to vote in the referendum. The referendum shall be
36held on a one-acre, one-vote basis at the expense of the
37district.
38     Section 6.  To the extent any conflict occurs between the
39provisions of this act and chapter 2005-307, Laws of Florida,
40this act shall govern. Nothing in this act shall be construed as
41altering any of the provisions of chapter 189 or chapter 298,
42Florida Statutes.
43     Section 7.  This act shall take effect on September 30,
442006, only upon its approval by a majority vote of those
45landowners of the Pal-Mar Water Control District voting in a
46referendum election to be called by the board of supervisors of
47the district and to be held prior to September 30, 2006, in
48accordance with the provisions of law relating to elections
49currently in force, except that this section and section 5 shall
50take effect upon becoming a law.
