10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. Pursuant to sections 189.4042(2) and |
13 | 189.4045(2), Florida Statutes, the Pal-Mar Water Control |
14 | District is hereby dissolved, subject to the requirements stated |
15 | in this act. |
16 | Section 2. Chapter 2005-307, Laws of Florida, is repealed. |
17 | Section 3. Title to all real property owned by the Pal-Mar |
18 | Water Control District is transferred as of September 30, 2006, |
19 | to Palm Beach County or Martin County, according to |
20 | jurisdictional location. |
21 | Section 4. All other assets or personal property and |
22 | liabilities or indebtedness of the Pal-Mar Water Control |
23 | District are transferred as of September 30, 2006, to Palm Beach |
24 | County or Martin County, pursuant to an interlocal agreement to |
25 | be executed among Palm Beach County, Martin County, the South |
26 | Florida Water Management District, and any other appropriate |
27 | governmental agency. The interlocal agreement shall ensure that |
28 | any transferred funds are used to support ongoing maintenance or |
29 | land acquisition for water quality or water quantity within the |
30 | Pal-Mar Water Control District. |
31 | Section 5. Prior to September 30, 2006, a landowner |
32 | referendum shall be held by the board of supervisors of the Pal- |
33 | Mar Water Control District on the question of whether the |
34 | district should be dissolved. All landowners within the district |
35 | are entitled to vote in the referendum. The referendum shall be |
36 | held on a one-acre, one-vote basis at the expense of the |
37 | district. |
38 | Section 6. To the extent any conflict occurs between the |
39 | provisions of this act and chapter 2005-307, Laws of Florida, |
40 | this act shall govern. Nothing in this act shall be construed as |
41 | altering any of the provisions of chapter 189 or chapter 298, |
42 | Florida Statutes. |
43 | Section 7. This act shall take effect on September 30, |
44 | 2006, only upon its approval by a majority vote of those |
45 | landowners of the Pal-Mar Water Control District voting in a |
46 | referendum election to be called by the board of supervisors of |
47 | the district and to be held prior to September 30, 2006, in |
48 | accordance with the provisions of law relating to elections |
49 | currently in force, except that this section and section 5 shall |
50 | take effect upon becoming a law. |
