  2         An act relating to youthful offenders; amending

  3         s. 958.045, F.S.; deleting a provision limiting

  4         certain sentencing options available to the

  5         court following a violation of the conditions

  6         of probation by a youthful offender; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Paragraph (c) of subsection (5) of section

12  958.045, Florida Statutes, is amended to read:

13         958.045  Youthful offender basic training program.--

14         (5)

15         (c)  The portion of the sentence served prior to

16  placement in the basic training program may not be counted

17  toward program completion. Upon the offender's completion of

18  the basic training program, the department shall submit a

19  report to the court that describes the offender's performance.

20  If the offender's performance has been satisfactory, the court

21  shall issue an order modifying the sentence imposed and

22  placing the offender on probation. The term of probation may

23  include placement in a community residential program. If the

24  offender violates the conditions of probation, the court may

25  revoke probation and impose any sentence that it might have

26  originally imposed as a condition of probation.

27         Section 2.  This act shall take effect July 1, 2006.
