11  The Committee on Government Efficiency Appropriations
12  (Haridopolos) recommended the following substitute for
13  amendment (763536):

15         Senate Amendment (with title amendment) 
16         On page 17, between lines 30 and 31,
17  
18  insert:  
19         Section 15.  Paragraph (a) of subsection (1) of section
20  500.12, Florida Statutes, is amended to read:
21         500.12  Food permits; building permits.--
22         (1)(a)  A food permit from the department is required
23  of any person who operates a food establishment or retail food
24  store, except:
25         1.  Persons operating minor food outlets, including,
26  but not limited to, video stores, that sell commercially
27  prepackaged, nonpotentially hazardous candy, chewing gum,
28  soda, or popcorn, provided the shelf space for those items
29  does not exceed 12 linear feet and no other food is sold by
30  the minor food outlet.
31         2.  Persons subject to continuous, onsite federal or

 1  state inspection.
 2         3.  Persons selling only legumes in the shell, either
 3  parched, roasted, or boiled.
 4         4.  Persons selling sugar cane or sorghum syrup that
 5  has been boiled and bottled on a premise located within the
 6  state. Such bottles must contain a label listing the
 7  producer's name and street address, and all added ingredients,
 8  the net weight or volume of product, and a statement that
 9  reads, "This product has not been produced in a facility
10  permitted by the Florida Department of Agriculture and
11  Consumer Services".
