11  The Committee on Communications and Public Utilities (Miller)
12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 18, between lines 19 and 20,
16  
17  insert:  
18         Section 9.  Section 556.111, Florida Statutes, is
19  amended to read:
20         556.111  Applicability to existing law.--Nothing in
21  this act shall be construed to:
22         (1)  Constitute the establishment or enlargement of any
23  rights to the use of real property or create an interest
24  therein for the placement, construction, repair, maintenance,
25  relocation, or excavation or demolition of any underground
26  facility;
27         (2)  Waive any right of a party having an interest in
28  real property to charge any fee for the use regarding such
29  property; or
30         (3)  Preempt a governmental member operator from
31  reasonable regulation of its right-of-way; however, this

 1  subsection does not exempt, and may not be used by the
 2  governmental member operator as the basis to exempt, the
 3  governmental member operator from complying with the
 4  provisions of this section which apply to a governmental
 5  member operator, including s. 556.105.

12         On page 2, line 18, after the semicolon,

14  insert:
15         amending s. 556.111, F.S.; providing that
16         certain provisions do not preempt a
17         governmental member operator from regulation of
18         its right-of-way under certain conditions;
