A bill to be entitled
2An act relating to the North Naples Fire Control and
3Rescue District, Collier County; amending chapter 99-450,
4Laws of Florida; providing for the payment of certain
5taxes and fees and the application of certain regulations
6and requirements in the event of annexation by a
7municipality within the boundaries of the district;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Section 3 of Article III of section 3 of
13chapter 99-450, Laws of Florida, is amended to read:

Boundaries of the District
16     Section 3.  Section 171.093, Florida Statutes, applies to
17annexations by a municipality within the boundaries of the
18district. The annexing municipality shall annually pay the
19district the equivalent of the premium tax revenues authorized
20in sections 175.041 and 175.101, Florida Statutes, that are
21attributable to the annexed properties during the duration and
22until the later of the expiration of the period provided for in
23section 171.093(4), Florida Statutes, or the expiration of the
24interlocal agreement, or any extension of such agreement, as
25authorized in section 171.093(3), Florida Statutes. During the
26term of the district's provision of fire protection services to
27the annexed area, the district's regulations, inspection
28requirements, and authority to collect inspection fees and
29impact fees shall apply within the annexed area. In the event
30that property in the district is annexed by the City of Naples
31between January 1 and July 1 of any year, the property shall be
32regarded as removed from the North Naples Fire Control and
33Rescue District as of January 1 of that year for the purpose of
34the levy of general ad valorem taxes by the district. If
35annexation occurs after July 1, the property shall be assessed
36by the district for ad valorem taxes for that year. On and after
37the effective date of annexation, the district shall be relieved
38of providing fire service to the annexed area. The city and the
39district may reach an agreement to determine what portion, if
40any, of the existing indebtedness or property of the district
41shall be assumed by the municipality of which the annexed
42territory will become a part, the fair value of such
43indebtedness or property, and the manner of transfer and
44financing. Nothing herein shall relieve the property annexed
45from the payment of general obligation debt service incurred by
46the district before annexation.
47     Section 2.  This act shall take effect upon becoming a law.
