14 On page 3, between lines 20 and 21,

16 insert:
17 Section 4. Paragraph (c) of subsection (7) of section
18 381.028, Florida Statutes, is amended to read:
19 381.028 Adverse medical incidents.--
20 (7) PRODUCTION OF RECORDS.--
21 (c)1. Fees charged by a health care facility for
22 copies of records requested by a patient under s. 25, Art. X
23 of the State Constitution may not exceed the reasonable and
24 actual cost of complying with the request, including a
25 reasonable charge for the staff time necessary to search for
26 records and prevent the disclosure of the identity of any
27 patient involved in the adverse medical incident through
28 redaction or other means as required by the Health Insurance
29 Portability and Accountability Act of 1996 or its implementing
30 regulations. The health care facility may require payment, in
31 full or in part, before acting on the records request.

2 of records requested by a patient under s. 25, Art. X of the
3 State Constitution may not exceed the amount established under
4 s. 456.057(18) s. 456.057(16), which may include a reasonable
5 charge for the staff time necessary to prevent the disclosure
6 of the identity of any patient involved in the adverse medical
7 incident through redaction or other means as required by the
8 Health Insurance Portability and Accountability Act of 1996 or
9 its implementing regulations. The health care provider may
10 require payment, in full or in part, before acting on the
11 records request.
