  1                      A bill to be entitled

  2         An act relating to telecommunication rates;

  3         repealing ss. 364.059, 364.164, and 364.051(6),

  4         (7), and (8), F.S., relating to price

  5         regulation and competitive market enhancements

  6         of local exchange telecommunication companies;

  7         providing that any local telecommunications

  8         service rate that was increased and any

  9         corresponding telecommunications intrastate

10         access fee that was reduced by action of the

11         Florida Public Service Commission but that has

12         not yet been implemented is null and void;

13         providing that if a local telecommunications

14         service rate was increased and a corresponding

15         telecommunications intrastate access fee was

16         reduced, those rates and fees are suspended as

17         of a specified date, and thereafter a local

18         exchange telecommunications company must charge

19         local service rates and intrastate access fees

20         at the rates in effect on December 1, 2003;

21         providing an effective date.

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  Sections 364.059 and 364.164, and

26  subsections (6), (7), and (8) of s. 364.051, Florida Statutes,

27  are repealed.

28         Section 2.  (1)  Any local service rate that was

29  increased and any corresponding intrastate access fee that was

30  reduced by action of the Florida Public Service Commission

31  under former s. 364.164, Florida Statutes, but that has not

 1  yet been implemented because the rate increase has been stayed

 2  pending appellate review, is null and void as if never granted

 3  by the commission.

 4         (2)  Any local service rate that was increased and any

 5  corresponding intrastate access fee that was reduced by action

 6  of the commission under former s. 364.164, Florida Statutes,

 7  and that has been implemented after appellate review, is

 8  suspended as of the effective date of this act. Thereafter, a

 9  local exchange telecommunications company must charge local

10  service rates and intrastate access fees at the rate in effect

11  on December 1, 2003.

12         Section 3.  This act shall take effect May 15, 2006, or

13  upon becoming a law, whichever occurs later.

16                          SENATE SUMMARY

17    Repeals certain statutes relating to price regulation and
      competitive market enhancements of local exchange
18    telecommunication companies. Provides that any local
      telecommunications service rate that was increased and
19    any corresponding telecommunications intrastate access
      fee that was reduced by action of the Public Service
20    Commission, but that has not yet been implemented, is
      null and void. Provides that if a local
21    telecommunications service rate was increased and a
      corresponding telecommunications intrastate access fee
22    was reduced, those rates and fees are suspended as of a
      specified date, and thereafter a local exchange
23    telecommunications company must charge local service
      rates and intrastate access fees at the rates in effect
