A bill to be entitled
2An act relating to the Division of Emergency Management of
3the Department of Community Affairs; amending s. 20.18,
4F.S.; providing that the director of the Division of
5Emergency Management shall be appointed by and serve under
6the oversight of the Governor; providing that the division
7shall be a separate budget entity and not subject to the
8control, supervision, or direction of the Department of
9Community Affairs in matters involving personnel,
10purchasing, and the budget of the division; authorizing
11the division to enter into a service agreement with the
12department for professional, technological, and
13administrative support services; requiring the division to
14collaborate and coordinate with the department on all
15nonemergency response matters; providing an effective
16date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  Paragraph (a) of subsection (2) of section
2120.18, Florida Statutes, is amended to read:
22     20.18  Department of Community Affairs.--There is created a
23Department of Community Affairs.
24     (2)  The following units of the Department of Community
25Affairs are established:
26     (a)  Division of Emergency Management. The director of the
27Division of Emergency Management shall be appointed by and shall
28serve under the oversight of the Governor in carrying out the
29responsibilities of chapter 252. The division shall be a
30separate budget entity and not subject to the control,
31supervision, or direction of the department in matters involving
32personnel, purchasing, and the budget of the division. The
33division shall enter into a service agreement with the
34department for professional, technological, and administrative
35support services. The division shall collaborate and coordinate
36with the department on all nonemergency response matters,
37including, but not limited to, disaster recovery programs, grant
38programs, mitigation programs, and emergency matters related to
39comprehensive plans.
40     Section 2.  This act shall take effect July 1, 2006.
