7An act relating to the Division of Emergency Management of
8the Department of Community Affairs; amending s. 20.18,
9F.S.; providing that the director of the Division of
10Emergency Management be designated as agency head of the
11division; providing for appointment of the director by the
12Governor; providing that the division is a separate budget
13entity, not subject to control by the department;
14providing for an agreement between the division and
15department for certain services; prescribing duties of the
16division; providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Paragraph (a) of subsection (2) of section
2120.18, Florida Statutes, is amended to read:
22     20.18  Department of Community Affairs.--There is created a
23Department of Community Affairs.
24     (2)  The following units of the Department of Community
25Affairs are established:
26     (a)  Division of Emergency Management. The division is a
27separate budget entity and is not subject to control,
28supervision, or direction by the Department of Community Affairs
29in any manner, including, but not limited to, personnel,
30purchasing, transactions involving personal property, and
31budgetary matters. The division director shall be appointed by
32the Governor, shall serve at the pleasure of the Governor, and
33shall be the agency head of the division for all purposes. The
34division shall enter into a service agreement with the
35department for professional, technological, and administrative
36support services. The division shall collaborate and coordinate
37with the department on nonemergency response matters, including,
38but not limited to, disaster recovery programs, grant programs,
39mitigation programs, and emergency matters related to
40comprehensive plans.
41     Section 2.  This act shall take effect July 1, 2006.
