A bill to be entitled
2An act relating to the Division of Emergency Management of
3the Department of Community Affairs; amending s. 20.18,
4F.S.; providing that the director of the Division of
5Emergency Management be designated as agency head of the
6division; providing for appointment of the director by the
7Governor; providing that the division is a separate budget
8entity, not subject to control by the department;
9providing for an agreement between the division and
10department for certain services; prescribing duties of the
11division; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Paragraph (a) of subsection (2) of section
1620.18, Florida Statutes, is amended to read:
17     20.18  Department of Community Affairs.--There is created a
18Department of Community Affairs.
19     (2)  The following units of the Department of Community
20Affairs are established:
21     (a)  Division of Emergency Management. The division is a
22separate budget entity and is not subject to control,
23supervision, or direction by the Department of Community Affairs
24in any manner, including, but not limited to, personnel,
25purchasing, transactions involving personal property, and
26budgetary matters. The division director shall be appointed by
27the Governor, shall serve at the pleasure of the Governor, and
28shall be the agency head of the division for all purposes. The
29division shall enter into a service agreement with the
30department for professional, technological, and administrative
31support services. The division shall collaborate and coordinate
32with the department on nonemergency response matters, including,
33but not limited to, disaster recovery programs, grant programs,
34mitigation programs, and emergency matters related to
35comprehensive plans.
36     Section 2.  This act shall take effect July 1, 2006.
