8 | entity, not subject to control by the department; |
9 | providing for an agreement between the division and |
10 | department for certain services; prescribing duties of the |
11 | division; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |

15 | Section 1. Paragraph (a) of subsection (2) of section |
16 | 20.18, Florida Statutes, is amended to read: |
17 | 20.18 Department of Community Affairs.--There is created a |
18 | Department of Community Affairs. |
19 | (2) The following units of the Department of Community |
20 | Affairs are established: |
21 | (a) Division of Emergency Management. The division is a |
22 | separate budget entity and is not subject to control, |
23 | supervision, or direction by the Department of Community Affairs |
24 | in any manner, including, but not limited to, personnel, |
25 | purchasing, transactions involving personal property, and |
26 | budgetary matters. The division director shall be appointed by |
27 | the Governor, shall serve at the pleasure of the Governor, and |
28 | shall be the agency head of the division for all purposes. The |
29 | division shall enter into a service agreement with the |
30 | department for professional, technological, and administrative |
31 | support services. The division shall collaborate and coordinate |
32 | with the department on nonemergency response matters, including, |
33 | but not limited to, disaster recovery programs, grant programs, |
34 | mitigation programs, and emergency matters related to |
35 | comprehensive plans. |
36 | Section 2. This act shall take effect July 1, 2006. |
