5     (3)(a)  To include in a plan of improvements, the
6engineer's report, chapter 170 authorizing documents, or
7otherwise provide, for the exercise of the district's powers,
8services, facilities, and improvements beyond the territorial
9boundaries of the district, when necessary and appropriate in
10order to provide a benefit on behalf of lands located within the
11district and pursuant to an approved plan of improvements or
12chapter 170 authorizing documents. Any such construction must be
13in accordance with the city's master plans and requirements. Any
14such construction within unincorporated Sarasota County must be
15in accordance with the county's comprehensive plan, master
16plans, and thoroughfare plan. The West Villages Improvement
17district shall cooperate and coordinate its activities with the
18units of general-purpose local government in which it is
19located, including the City of North Port and Sarasota County.
20Prior to exercising any of the district powers, functions, or
21duties relative to infrastructure planning, programming, or
22construction within that portion of the district located in
23unincorporated Sarasota County, the district shall enter into an
24interlocal agreement with Sarasota County, which agreement shall
25specify the process for the district to coordinate its
26infrastructure planning, programming, and construction
27activities with Sarasota County and include a means to
28coordinate infrastructure planning and programming between the
29parties. Neither the district nor Sarasota County shall
30arbitrarily or unreasonably withhold or delay its approval and
31execution of such interlocal agreement. The district is
32authorized to enter into interlocal agreements with the City of
33North Port, Sarasota County, the Englewood Water District, or
34any other units of government. Whenever the district intends to
35utilize its powers to construct or cause to be constructed
36infrastructure projects or programs within the district, the
37district shall provide copies of all plans and infrastructure
38permit applications to the Sarasota County Planning Director and
39Development Services Business Center at such time as the
40district submits such plans or permit applications to the City
41of North Port or other permitting authority but in any event no
42less than 30 days before the City of North Port or other
43permitting authority issues permits for those projects. The
44district shall allow the county 20 days from submittal to the
45county to comment on those plans and permit applications, but as
46to construction or improvements that are not within
47unincorporated Sarasota County, the county's approval is not
48required for the district to proceed with the project. Sarasota
49County shall not unduly interfere with the district's exercise
50of its powers conferred by this act.
51     (b)  Prior to planning, programming, or construction of any
52infrastructure that is intended to cross jurisdictional
53boundaries and be constructed in more than one unit of general-
54purpose local government, the Englewood Water District, or a
55combination thereof, the district shall enter into interlocal
56agreements with each of the affected governments, which
57agreements shall specify the process for the district to
58coordinate its infrastructure planning, programming, and
59construction activities with each affected government;
60coordinate compliance and resolve conflicts with the
61comprehensive plans, laws, and ordinances of the City of North
62Port and Sarasota County and with the adopted long-range plans
63and rules and regulations of the Englewood Water District; and
64establish procedures and responsibilities for maintenance,
65repair, and operation of any connected infrastructure. The
66district, the City of North Port, Sarasota County, and the
67Englewood Water District shall not arbitrarily or unreasonably
68withhold or delay their approval and execution of any such
69interlocal agreement.
