1 A bill to be entitled
2 An act relating to aggravating circumstances in
3 the commission of a capital felony; amending s.
4 921.141, F.S.; providing an additional
5 aggravating circumstance for imposing the death
6 penalty on a defendant who was under a court
7 order to have no contact with the victim at the
8 time of the commission of the felony; providing
9 an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (p) is added to subsection (5) of
14 section 921.141, Florida Statutes, to read:
15 921.141 Sentence of death or life imprisonment for
16 capital felonies; further proceedings to determine sentence.--
17 (5) AGGRAVATING CIRCUMSTANCES.--Aggravating
18 circumstances shall be limited to the following:
19 (p) The capital felony was committed by the defendant
20 while he or she was under a court order to have no contact or
21 to have no violent contact with the victim.
22 Section 2. This act shall take effect October 1, 2006.

25 SENATE SUMMARY
26 Provides an additional aggravating circumstance for
imposing the death penalty on a defendant who was under a
27 court order to have no contact with the victim at the
time of the commission of the felony.
