11 The Committee on Criminal Justice (Haridopolos) recommended
12 the following amendment:

14 Senate Amendment
15 On page 2, lines 9-27, delete those lines
16
17 and insert:
18 (4) A law enforcement officer, correctional officer,
19 or correctional probation officer seeking appointment,
20 reappointment, employment, or reemployment with the same
21 employing agency from which the law enforcement officer,
22 correctional officer, or correctional probation officer
23 retired under chapter 121 may be appointed, reappointed,
24 employed, or reemployed only at the lowest rank and pay scale
25 for a certified law enforcement officer, correctional officer,
26 or correctional probation officer within the employing agency.
27 Such appointment, reappointment, employment, or reemployment
28 must be at the lowest rank and pay scale for a certified law
29 enforcement officer, correctional officer, or correctional
30 probation officer within the employing agency for a minimum of
31 3 years after the effective date of retirement under s.

1 121.021(41) or terminated employment in accordance with the
2 requirements of the special risk normal retirement date.
3 (b) The certification of a law enforcement officer,
4 correctional officer, or correctional probation officer who
5 violates the provisions of this subsection shall become
6 inactive.
7 (c) This subsection does not otherwise limit the
8 employment or appointment opportunities for the law
9 enforcement officer, correctional officer, or correctional
10 probation officer at any employing agency other than the
11 employing agency from which the law enforcement officer,
12 correctional officer, or correctional probation officer
13 retired under chapter 121.
14 (d) This subsection does not change the applicable
15 limitations in s. 121.091(9).
16 (e) The limitations provided for in this subsection
17 are inapplicable when a law enforcement officer, correctional
18 officer, or correctional probation officer is elected to the
19 office of sheriff or appointed by the Governor to the office
20 of sheriff or other appointed office having responsibilities
21 of law enforcement, corrections, or correctional probation.
