1	A bill to be entitled
2	An act relating to Polk County; abolishing the Peace Creek
3	Drainage District and transferring its powers, duties,
4	functions, property, revenues, and indebtedness to the
5	Southwest Florida Water Management District; amending the
6	charter of the Lake Region Lakes Management District, as
7	reenacted and amended by chapter 2004-393, Laws of
8	Florida; redefining the territorial boundaries of the
9	district; providing for a referendum; providing an
10	effective date.

12	Be It Enacted by the Legislature of the State of Florida:
13
14	Section 1.  The Peace Creek Drainage District, a district
15	created under chapter 298, Florida Statutes, is abolished, and
16	all services being provided by the Peace Creek Drainage District
17	shall be assumed by, and all revenue, property, and indebtedness
18	of the Peace Creek Drainage District shall be transferred to,
19	the Southwest Florida Water Management District on July 1, 2006.
20	Section 2.  Section 1 of the charter of the Lake Region
21	Lakes Management District, Polk County, as reenacted and amended
22	by section 3 of chapter 2004-393, Laws of Florida, is amended to
23	read:
24	Section 1.  Purpose and territorial boundaries.--That for
25	the purpose of acquiring, constructing, operating, maintaining,
26	and protecting a system of boat canals, drainage canals; dams,
27	locks, and other proper and necessary works in connection
28	therewith, for the purpose of aiding in flood control, lake
29	level management, and protecting, maintaining, and improving the
30	water quality in the lakes and canals in conjunction with state,
31	county, and city agencies, for the purpose of connecting the
32	lakes within or adjacent to the boundaries hereinafter
33	prescribed, and for moving waters out of such lakes, and for the
34	purpose of promoting access to the lakes and the public
35	convenience, utility, and welfare, the Lake Region Lakes
36	Management District (the "district"), in Polk County has been
37	created and established, and is hereby confirmed, as an
38	independent special district, the territorial boundaries of
39	which are as follows, to wit:
40	(1)  Beginning at the center of east line of section
41	2, of or township twenty-eight (28) south, of range
42	twenty-six (26) east; thence south with section line
43	between section one (1) and two (2), eleven (11) and
44	twelve (12), thirteen (13) and fourteen (14), twenty-
45	three (23) and twenty-four (24), to the northeast
46	corner of section twenty-six (26) said township and
47	range; Thence east on section line to northeast corner
48	of northwest quarter of section 30, township 28 south,
49	range 27 east; Thence south with section line to the
50	southeast corner of the north quarter of section 31,
51	township 28 south, range 27 east; Thence west along
52	said quarter section line and its extension to an
53	intersection with the half section line of section 36,
54	township 28 south, range 26 east; twenty-five (25),
55	thence south with the half section line to the center
56	of section thirteen (13), township 29 south, range 26
57	east; Thence west on the half section line to the
58	southwest corner of the northwest quarter of section
59	line to the southwest corner of the northwest quarter
60	of section sixteen (16) said township and range;
61	Thence north with section line to the northwest corner
62	of the southwest quarter of section four (4), said
63	township and range; Thence west with the half section
64	line to center of section six (6) said township and
65	range; Thence north with half section line to the
66	northwest corner of northeast quarter (NE 1/4) of

84	three, twenty-five, twenty-six, twenty-seven, twenty-
85	eight, twenty-nine, thirty, thirty-two, thirty-three,
86	thirty-four, and thirty-five and the west half of
87	section sections twenty-five and thirty-six and the
88	east half of section thirty-one and the north half of
89	the northeast quarter of section thirty-six in
90	township 28 south, range 26 east and all of sections
91	two, three, four, nine, ten and eleven, and the west
92	half of sections one and twelve and the north half of
93	sections five, fourteen, fifteen and sixteen and the
94	northeast quarter of section six and the northwest

235	All of the above lands lying in Polk County, Florida.
236	Section 3.  In accordance with provisions of law relating
237	to elections currently in force, the Lake Region Lakes
238	Management District shall call and the Polk County Supervisor of
239	Elections shall conduct a referendum on or before November 30,
240	2008, of the qualified electors residing within the area
241	proposed to be annexed pursuant to section 2 of this act. The
242	term "qualified elector" means a person who is a registered
243	voter qualified to vote in a general election held in Polk
244	County. The purpose of said referendum shall be to determine
245	whether the boundaries of the Lake Region Lakes Management
246	District shall be expanded to annex land that is not currently
247	within the district's boundaries as described in section 2 and
248	to determine whether property within the annexed area shall be
249	subject to ad valorem taxation at a rate not to exceed 1 mill.
250	Section 4.  This act shall take effect only upon its
251	approval by a majority vote of those qualified electors voting
252	in the referendum as required by section 3 of this act, except
253	that this section, section 1, and section 3 shall take effect
254	upon becoming a law.
