1 A bill to be entitled
2 An act relating to public swimming and bathing
3 facilities; amending s. 514.0115, F.S.;
4 providing that private pools and water therapy
5 facilities connected with establishments where
6 licensed physical therapists practice and
7 licensed massage therapy establishments are
8 exempt from supervision or regulation by the
9 Department of Health; amending s. 480.043,
10 F.S.; providing for the adoption of rules
11 relating to the regulation of pools used in
12 conjunction with hydrotherapy in establishments
13 licensed pursuant to this section; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Subsection (1) of section 514.0115, Florida
19 Statutes, is amended to read:
20 514.0115 Exemptions from supervision or regulation;
21 variances.--
22 (1) Private pools and water therapy facilities
23 connected with facilities connected with hospitals, medical
24 doctors' offices, and licensed physical therapy establishments
25 where one or more licensed physical therapists practice, and
26 licensed massage therapy establishments are shall be exempt
27 from supervision under this chapter.
28 Section 2. Subsection (2) of section 480.043, Florida
29 Statutes, is amended to read:
30 480.043 Massage establishments; requisites; licensure;
31 inspection.--

1 (2) The board shall adopt rules governing the
2 operation of establishments and their facilities, personnel,
3 safety and sanitary requirements, including pools used in
4 conjunction with hydrotherapy in establishments licensed
5 pursuant to this section, financial responsibility, insurance
6 coverage, and the license application and granting process.
7 Section 3. This act shall take effect July 1, 2006.

9 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

12 This committee substitute provides an exemption from the
Department of Health's regulation of public swimming pools and
13 bathing facilities for private pools and water therapy
facilities connected with establishments where one or more
14 licensed physical therapists practice and licensed massage
establishments. The bill also clarifies that the Board of
15 Massage Therapy has the authority to adopt rules governing the
operation of licensed massage establishments, including pools
16 used in conjunction with hydrotherapy in licensed massage
establishments.
