1 A bill to be entitled
2 An act relating to independent special fire
3 control districts; amending s. 191.008, F.S.;
4 authorizing a district to recover court costs
5 and attorney's fees in civil actions involving
6 enforcement of the firesafety code; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Present subsections (5), (6), and (7) of
12 section 191.008, Florida Statutes, are redesignated as
13 subsections (6), (7), and (8), respectively, and a new
14 subsection (5) is added to the section, to read:
15 191.008 Special powers.--Independent special fire
16 control districts shall provide for fire suppression and
17 prevention by establishing and maintaining fire stations and
18 fire substations and acquiring and maintaining such
19 firefighting and fire protection equipment deemed necessary to
20 prevent or fight fires. All construction shall be in
21 compliance with applicable state, regional, and local
22 regulations, including adopted comprehensive plans and land
23 development regulations. The board shall have and may
24 exercise any or all of the following special powers relating
25 to facilities and duties authorized by this act:
26 (5) Recover reasonable court costs, including
27 attorney's fees, from the nonprevailing party in any civil
28 action to enforce the provisions of chapter 553 or chapter 633
29 and this section concerning fire suppression and prevention
30 and the enforcement of the firesafety code in which the
31 special district is the prevailing party.

1 Section 2. This act shall take effect July 1, 2006.
