| 7 | district; providing for election or appointment of |
| 8 | supervisors; providing for approval of the budget of the |
| 9 | district; providing for powers and responsibilities of the |
| 10 | district; providing a ballot statement; providing for a |
| 11 | referendum; providing an effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. Chapter 63-609, Laws of Florida, is hereby |
| 16 | repealed, except that said special act is hereby declared to be |
| 17 | an ordinance of the City of Coral Springs subject to the |
| 18 | procedure of amendment and repeal as any other duly enacted |
| 19 | ordinance of the City of Coral Springs in conformance with this |
| 20 | act. |
| 21 | Section 2. Notwithstanding chapter 298, Florida Statutes, |
| 22 | upon the expiration of the term of any supervisor of the |
| 23 | Sunshine Water Control District, the City of Coral Springs may |
| 24 | provide for the election or appointment of a replacement |
| 25 | supervisor by ordinance of the City of Coral Springs. |
| 26 | Section 3. Notwithstanding anything contained in chapter |
| 27 | 63-609, Laws of Florida, any budget of the Sunshine Water |
| 28 | Control District approved subsequent to the effective date of |
| 29 | this act shall be approved by the City of Coral Springs pursuant |
| 30 | to the procedures provided for in chapters 189 and 200, Florida |
| 31 | Statutes, and in compliance with the Charter of the City of |
| 32 | Coral Springs. |
| 33 | Section 4. Subsequent to the effective date of this act, |
| 34 | the Sunshine Water Control District shall be determined to be a |
| 35 | dependent special district of the City of Coral Springs. |
| 36 | Section 5. Nothing in this act shall preclude the Sunshine |
| 37 | Water Control District from using any power contained in chapter |
| 38 | 298, Florida Statutes, except as provided in this act. |
| 39 | Section 6. All title to property, uncollected taxes and |
| 40 | assessments, judgments, causes of action, and property rights |
| 41 | held or owned by the Sunshine Water Control District shall |
| 42 | continue to be vested in the Sunshine Water Control District, |
| 43 | and no obligations or contracts, including bonds or causes of |
| 44 | action, shall be impaired or avoided by this act. All contracts, |
| 45 | franchises, and permits to do business issued by the Sunshine |
| 46 | Water Control District shall remain in full force and effect |
| 47 | according to their terms. |
| 48 | Section 7. The City of Coral Springs is hereby directed to |
| 49 | call a special referendum election to be held in conjunction |
| 50 | with the general election to be held on November 7, 2006. The |
| 51 | item that shall appear on the ballot shall be as follows: |

| 53 | Sunshine Water Control District to be a part of the City of |
| 54 | Coral Springs |
| 55 |
|
| 56 | Shall the Sunshine Water Control District, an independent |
| 57 | government, become a dependent district of the City of Coral |
| 58 | Springs subject to the city's control? |

| 64 | Section 8. This act shall take effect only upon approval |
| 65 | by a majority vote of the qualified electors of the City of |
| 66 | Coral Springs voting in a referendum to be held in conjunction |
| 67 | with the general election to be held on November 7, 2006, in |
| 68 | accordance with the provisions of law relating to elections |
| 69 | currently in force, except that this section shall take effect |
| 70 | upon becoming a law. |
