A bill to be entitled
2An act relating to cardrooms; amending s. 849.086, F.S.;
3deleting a provision authorizing cardrooms to operate only
4during authorized pari-mutuel events; deleting an
5exception that allows pari-mutuel permitholders to operate
6cardrooms on certain days when they are not holding pari-
7mutuel events; providing hours of operation for cardrooms
8at any horserace, greyhound, or jai alai facility that
9conducted a full schedule of racing or games in the
10preceding year; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Paragraph (b) of subsection (7) of section
15849.086, Florida Statutes, is amended to read:
16     849.086  Cardrooms authorized.--
17     (7)  CONDITIONS FOR OPERATING A CARDROOM.--
18     (b)  Any horserace, greyhound, or jai alai permitholder
19licensed under this chapter may operate a cardroom at the pari-
20mutuel facility on any day between the hours of 12 noon and 12
21midnight if the permitholder conducted a full schedule of live
22racing or games in the preceding year. A cardroom may be
23operated at the facility only when the facility is authorized to
24accept wagers on pari-mutuel events during its authorized meet.
25A cardroom may operate between the hours of 12 noon and 12
26midnight on any day a pari-mutuel event is conducted live as a
27part of its authorized meet. However, a permitholder who holds a
28valid cardroom license may operate a cardroom between the hours
29of 12 noon and 12 midnight on any day that live racing of the
30same class of permit is occurring within 35 miles of its
31facility if no other holder of that same class of permit within
3235 miles is operating a cardroom at such time and if all holders
33of the same class of permit within the 35-mile area have given
34their permission in writing to the permitholder to operate the
35cardroom during the designated period. Application to operate a
36cardroom under this paragraph must be made to the division as
37part of the annual license application.
38     Section 2.  This act shall take effect July 1, 2006.
