1 Senate Joint Resolution
2 A joint resolution proposing an amendment to
3 Section 7 of Article II of the State
4 Constitution to prohibit drilling or
5 exploration for oil or natural gas within
6 sovereignty submerged lands and within a
7 specified distance offshore and to direct the
8 Legislature to enact enforcing legislation.

10 Be It Resolved by the Legislature of the State of Florida:
11
12 That the following amendment to Section 7 of Article II
13 of the State Constitution is agreed to and shall be submitted
14 to the electors of this state for approval or rejection at the
15 next general election or at an earlier special election
16 specifically authorized by law for that purpose:
17 ARTICLE II
18 GENERAL PROVISIONS
19 SECTION 7. Natural resources and scenic beauty.--
20 (a) It shall be the policy of the state to conserve
21 and protect its natural resources and scenic beauty. Adequate
22 provision shall be made by law for the abatement of air and
23 water pollution and of excessive and unnecessary noise and for
24 the conservation and protection of natural resources.
25 (b) Those in the Everglades Agricultural Area who
26 cause water pollution within the Everglades Protection Area or
27 the Everglades Agricultural Area shall be primarily
28 responsible for paying the costs of the abatement of that
29 pollution. For the purposes of this subsection, the terms
30 "Everglades Protection Area" and "Everglades Agricultural

1 Area" shall have the meanings as defined in statutes in effect
2 on January 1, 1996.
3 (c) Drilling or exploration for oil or natural gas is
4 prohibited within sovereignty submerged lands and within 200
5 miles waterward of the coastline to the maximum extent allowed
6 by United States or international law. The legislature shall
7 enact legislation to enforce this subsection.
8 BE IT FURTHER RESOLVED that the following statement be
9 placed on the ballot:
10 CONSTITUTIONAL AMENDMENT
11 ARTICLE II, SECTION 7
12 PROHIBITING DRILLING OR EXPLORATION FOR OIL OR NATURAL
13 GAS.--Proposing an amendment to the State Constitution to
14 provide that drilling or exploration for oil or natural gas
15 shall be prohibited within sovereignty submerged lands and
16 within 200 miles waterward of the coastline to the maximum
17 extent allowed by United States or international law and to
18 direct the Legislature to enact legislation enforcing this
19 provision.
