14 Delete everything after the resolving clause

16 and insert:
17 That the following amendment to Section 6 of Article X
18 of the State Constitution is agreed to and shall be su
19 to the electors of this state for approval or rejection at the
20 next general election or at an earlier special election
21 specifically authorized by law for that purpose:
22 ARTICLE X
23 MISCELLANEOUS
24 SECTION 6. Eminent domain.--
25 (a) No private property shall be taken except for a
26 public purpose and with full compensation therefor paid to
27 each owner or secured by deposit in the registry of the court
28 and available to the owner.
29 (b) Provision may be made by law for the taking of
30 easements, by like proceedings, for the drainage of the land
31 of one person over or through the land of another.

1 (c) Private property taken by eminent domain pursuant
2 to a petition to initiate condemnation proceedings filed on or
3 after January 2, 2007, may not be conveyed to a natural person
4 or private entity except as provided by general law passed by
5 a three-fifths vote of the membership of each house of the
6 Legislature.
7 BE IT FURTHER RESOLVED that the following statement be
8 placed on the ballot:
9 CONSTITUTIONAL AMENDMENT
10 ARTICLE X, SECTION 6
11 EMINENT DOMAIN.--Proposing an amendment to the State
12 Constitution to prohibit the transfer of private property
13 taken by eminent domain to a natural person or private entity;
14 providing that the Legislature may by general law passed by a
15 three-fifths vote of the membership of each house of the
16 Legislature permit exceptions allowing the transfer of such
17 private property; and providing that this prohibition on the
18 transfer of private property taken by eminent domain is
19 applicable if the petition of taking that initiated the
20 condemnation proceeding was filed on or after January 2, 2007.
