2An act relating to homestead assessments; amending s.
3193.155, F.S.; providing an additional criterion for
4determining no change in ownership of homestead property
5for homestead assessment purposes; specifying a condition
6for a change in ownership; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (a) of subsection (3) of section
11193.155, Florida Statutes, is amended to read:
12     193.155  Homestead assessments.--Homestead property shall
13be assessed at just value as of January 1, 1994. Property
14receiving the homestead exemption after January 1, 1994, shall
15be assessed at just value as of January 1 of the year in which
16the property receives the exemption.
17     (3)  Except as provided in this subsection, property
18assessed under this section shall be assessed at just value as
19of January 1 of the year following a change of ownership.
20Thereafter, the annual changes in the assessed value of the
21property are subject to the limitations in subsections (1) and
22(2). For the purpose of this section, a change in ownership
23means any sale, foreclosure, or transfer of legal title or
24beneficial title in equity to any person, except as provided in
25this subsection. There is no change of ownership if:
26     (a)  Subsequent to the change or transfer, the same person
27is entitled to the homestead exemption as was previously
28entitled and:
29     1.  The transfer of title is to correct an error; or
30     2.  The transfer is between legal and equitable title; or
31     3.  The change or transfer merely adds an additional person
32or persons to the title and none of the persons added apply for
33homestead exemption on that property. Notwithstanding this
34subparagraph, there is a change of ownership if a person who was
35added to a title as described in this subparagraph applies for a
36homestead exemption on the property;
37     Section 2.  This act shall take effect July 1, 2006.
