1 A bill to be entitled
2 An act relating to a review under the Open
3 Government Sunset Review Act; amending s.
4 626.921, F.S., relating to an exemption from
5 public-records requirements for certain
6 information concerning surplus lines insurance
7 which is specific to a particular policy or
8 policyholder and is submitted to the Department
9 of Financial Services or the Florida Surplus
10 Lines Service Office; saving the exemption
11 provided for information submitted to the
12 Florida Surplus Lines Office from repeal under
13 the Open Government Sunset Review Act; revising
14 provisions authorizing the office to disclose
15 information to the department; deleting
16 provisions applying the exemption to
17 information the department receives from the
18 office; deleting provisions that provide for
19 the repeal of the exemption; providing an
20 effective date.

22 Be It Enacted by the Legislature of the State of Florida:

24 Section 1. Subsection (8) of section 626.921, Florida
25 Statutes, is amended to read:
26 626.921 Florida Surplus Lines Service Office.--
27 (8)(a) Information furnished to the department under
28 s. 626.923 or contained in the records subject to examination
29 by the department under s. 626.930 is confidential and exempt
30 from the provisions of s. 119.07(1) and s. 24(a), Art. I of
31 the State Constitution if the disclosure of the information

1 would reveal information specific to a particular policy or
2 policyholder. The exemption does not apply to any proceeding
3 instituted by the department or office against an agent or
4 insurer.
5 (b) Information furnished to the Florida Surplus Lines
6 Service Office under the Surplus Lines Law is confidential and
7 exempt from the provisions of s. 119.07(1) and s. 24(a), Art.
8 I of the State Constitution if the disclosure of the
9 information would reveal information specific to a particular
10 policy or policyholder. However, This exemption does not
11 prevent the disclosure of any information by the Florida
12 Surplus Lines Service Office may, in furtherance of its duties
13 and responsibilities, disclose such information to the
14 department, but the exemption applies to records obtained by
15 the department from the Florida Surplus Lines Service Office.
16 The exemption does not apply to any proceeding instituted by
17 the department or office against an agent or insurer. This
18 paragraph is subject to the Open Government Sunset Review Act
19 of 1995 in accordance with s. 119.15, and shall stand repealed
20 on October 2, 2006, unless reviewed and saved from repeal
21 through reenactment by the Legislature.
22 Section 2. This act shall take effect October 1, 2006.
