16 | amending s. 320.0807, F.S.; creating special license |
17 | plates for legislative presiding officers; amending s. |
18 | 320.08056, F.S.; establishing an annual use fee for the |
19 | Future Farmers of America license plate; amending s. |
20 | 320.08058, F.S.; creating the Future Farmers of America |
21 | license plate and providing for use of funds received from |
22 | the sale of the plates; providing an effective date. |

24 | Be It Enacted by the Legislature of the State of Florida: |
25 |
|
26 | Section 1. Paragraph (z) of subsection (4) and paragraph |
27 | (a) of subsection (8) of section 320.08056, Florida Statutes, |
28 | are amended, and paragraph (eee) is added to subsection (4) of |
29 | that section, to read: |
30 | 320.08056 Specialty license plates.-- |
31 | (4) The following license plate annual use fees shall be |
32 | collected for the appropriate specialty license plates: |
33 | (z) Florida Memorial University College license plate, |
34 | $25. |
35 | (eee) Homeownership For All license plate, $25. |
36 | (8)(a) The department must discontinue the issuance of an |
37 | approved specialty license plate if the number of valid |
38 | specialty plate registrations falls below 1,000 plates for at |
39 | least 12 consecutive months. A warning letter shall be mailed to |
40 | the sponsoring organization following the first month in which |
41 | the total number of valid specialty plate registrations is below |
42 | 1,000 plates. The provisions of this subsection do not apply to |
43 | collegiate license plates established pursuant to s. |
44 | 320.08058(3). |
45 | Section 2. Subsections (23), (26), and (48) of section |
46 | 320.08058, Florida Statutes, are amended, and subsection (57) is |
47 | added to that section, to read: |
48 | 320.08058 Specialty license plates.-- |
49 | (23) KEEP KIDS DRUG-FREE LICENSE PLATES.-- |
50 | (a) The department shall develop a Keep Kids Drug-Free |
51 | license plate as provided in this section. The word "Florida" |
52 | must appear at the top of the plate, and the words "Keep Kids |
53 | Drug-Free" must appear at the bottom of the plate. |
54 | (b) The annual use fees shall be distributed to the Keep |
55 | Kids Drug-Free Foundation, Inc., which shall use the fees to |
56 | fund activities to reduce substance abuse among residents of |
57 | this state. The foundation shall develop a plan to distribute |
58 | the funds for drug-abuse prevention programs. |
59 | (c) Notwithstanding s. 320.08062, up to 10 percent of the |
60 | proceeds from the annual use fee may be used for marketing the |
61 | Keep Kids Drug-Free license plate and for administrative costs |
62 | directly related to the management and distribution of the |
63 | proceeds. |
64 | (26) FLORIDA MEMORIAL UNIVERSITY COLLEGE LICENSE PLATES.-- |
65 | (a) The department shall develop a Florida Memorial |
66 | University College license plate as provided in this section. |
67 | The word "Florida" must appear at the top of the plate, and the |
68 | words "Florida Memorial University College" must appear at the |
69 | bottom of the plate. |
70 | (b) The annual use fees shall be distributed to Florida |
71 | Memorial University College. |
72 | (48) SPORTSMEN'S NATIONAL LAND TRUST LICENSE PLATES.-- |
73 | (a) The department shall develop a Sportsmen's National |
74 | Land Trust license plate as provided in this section. The word |
75 | "Florida" must appear at the top of the plate, and the words |
76 | "Sportsmen's National Land Trust" must appear at the bottom of |
77 | the plate. |
78 | (b) The annual revenues from the sales of the license |
79 | plate shall be distributed to the Sportsmen's National Land |
80 | Trust. Such annual revenues must be used by the trust in the |
81 | following manner: |
82 | 1. Fifty percent may be retained until fifty percent of |
83 | all startup costs for developing and establishing the plate have |
84 | been recovered. |
85 | 2. Twenty-five percent must be used to fund programs and |
86 | projects within the state that preserve open space and wildlife |
87 | habitat, promote conservation, improve wildlife habitat, and |
88 | establish open space for the perpetual use of the public. |
89 | 3. Twenty-five percent may be used for promotion, |
90 | marketing, and administrative costs directly associated with |
91 | operation of the trust. |
92 | (c) When the provisions of subparagraph (b)1. are met, |
93 | those annual revenues shall be used for the purposes of |
94 | subparagraph (b)2. |
95 | (57) HOMEOWNERSHIP FOR ALL LICENSE PLATES.-- |
96 | (a) The department shall develop a Homeownership For All |
97 | license plate as provided in this section. The word "Florida" |
98 | must appear at the top of the plate, and the words "Support |
99 | Homeownership For All" must appear at the bottom of the plate. |
100 | (b) The annual use fees shall be distributed to |
101 | Homeownership For All, Inc., which may use a maximum of 10 |
102 | percent of the proceeds to promote and market the plate. The |
103 | remainder of the proceeds shall be used by Homeownership For |
104 | All, Inc., to fund programs that provide, promote, or otherwise |
105 | support affordable housing in this state. |
106 | Section 3. Subsection (5) of section 320.0807, Florida |
107 | Statutes, is renumbered as subsection (6), and a new subsection |
108 | (5) is added to that section to read: |
109 | 320.0807 Special license plates for Governor and federal |
110 | and state legislators.-- |
111 | (5) Upon application by any current or former President of |
112 | the Senate and payment of the fees prescribed by s. 320.0805, |
113 | the department is authorized to issue a license plate stamped in |
114 | bold letters "Senate President" followed by the number assigned |
115 | by the department or chosen by the applicant if it is not |
116 | already in use. Upon application by any current or former |
117 | Speaker of the House of Representatives and payment of the fees |
118 | prescribed by s. 320.0805, the department is authorized to issue |
119 | a license plate stamped in bold letters "House Speaker" followed |
120 | by the number assigned by the department or chosen by the |
121 | applicant if it is not already in use. |
122 | Section 4. Paragraph (fff) is added to subsection (4) of |
123 | section 320.08056, Florida Statutes, as amended by this act, to |
124 | read: |
125 | 320.08056 Specialty license plates.-- |
126 | (4) The following license plate annual use fees shall be |
127 | collected for the appropriate specialty license plates: |
128 | (fff) Future Farmers of America license plate, $25. |
129 | Section 5. Subsection (58) is added to section 320.08058, |
130 | Florida Statutes,, as amended by this act, to read: |
131 | 320.08058 Specialty license plates.-- |
132 | (58) FUTURE FARMERS OF AMERICA LICENSE PLATES.-- |
133 | (a) Notwithstanding s. 320.08053, the department shall |
134 | develop a Future Farmers of America license plate as provided in |
135 | this section. Future Farmers of America license plates must bear |
136 | the colors and design approved by the department. The word |
137 | "Florida" must appear at the top of the plate, and the words |
138 | "Agricultural Education" must appear at the bottom of the plate. |
139 | (b) The license plate annual use fee shall be distributed |
140 | quarterly to the Florida Future Farmers of America Foundation, |
141 | Inc., to fund activities and services of the Future Farmers of |
142 | America. |
143 | (c) The Florida Future Farmers of America Foundation, |
144 | Inc., shall retain all revenue from the annual use fees until |
145 | all startup costs for developing and establishing the plates |
146 | have been recovered. Thereafter, up to 10 percent of the annual |
147 | use fee revenue may be used for administrative, handling, and |
148 | disbursement expenses and up to 5 percent may be used for |
149 | advertising and marketing costs. All remaining annual use fee |
150 | revenue shall be used by the Florida Future Farmers of America |
151 | Foundation, Inc., to fund its activities, programs, and |
152 | projects, including, but not limited to, student and teacher |
153 | leadership programs, the Foundation for Leadership Training |
154 | Center, teacher recruitment and retention, and other special |
155 | projects. |
156 | Section 6. This act shall take effect July 1, 2006. |
