11 The Committee on Criminal Justice (Haridopolos) recommended
12 the following amendment:

14 Senate Amendment (with directory and title amendments)
15 On page 9, between lines 27 and 28,
16
17 insert:
18 (8)(a) Anti-fraud plans or anti-fraud investigative
19 unit descriptions required to be furnished to the division
20 pursuant to this section are trade secrets as defined in s.
21 688.002, and a court or administrative hearing officer shall
22 preserve the secrecy of such anti-fraud plans or anti-fraud
23 investigative unit descriptions by reasonable means, which may
24 include granting protective orders in connection with
25 discovery proceedings, holding in camera hearings, sealing the
26 records of the action, and ordering any person involved in the
27 litigation not to disclose the alleged trade secret without
28 prior court approval.
29 (b) Findings, statements, discussions, reports, or
30 documentation generated by the department or the office
31 relating to anti-fraud plans or anti-fraud investigative unit

1 descriptions, if determined to contain trade secrets as
2 defined in s. 688.002, may be subject to the same protections
3 from unauthorized disclosure as are provided for the
4 anti-fraud plans or anti-fraud investigative unit descriptions
5 in paragraph (a).

9 And the directory clause is amended as follows:
10 On page 9, lines 4 and 5, delete those lines

12 and insert:
13 Section 9. Subsection (7) of section 626.9891, Florida
14 Statutes, is amended, and present subsection (8) of that
15 section is redesignated as subsection (9), and a new
16 subsection (8) is added to that section, to read:

20 And the title is amended as follows:
21 On page 2, line 10, after the first semicolon,

23 insert:
24 providing that anti-fraud plans and anti-fraud
25 investigative unit descriptions are trade
26 secrets; requiring certain hearing officers to
27 preserve the secrecy of such trade secrets;
28 providing that findings, statements, and
29 documents relating to anti-fraud plans and
30 anti-fraud investigative unit descriptions may
31 be subject to similar unauthorized disclosure;
