  1                      A bill to be entitled

  2         An act relating to adoption; amending s.

  3         63.042, F.S.; defining the standard for

  4         selecting an adoptive parent; requiring

  5         individual assessment of prospective adoptive

  6         parents of a minor; eliminating the ban on

  7         adoption by a person who is a homosexual;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (3) of section 63.042, Florida

13  Statutes, is amended to read:

14         63.042  Who may be adopted; who may adopt.--

15         (3)  The standard for selecting an adoptive parent

16  shall be the best interest of the person to be adopted.  A

17  prospective adoptive parent of a minor must undergo an

18  individual assessment of his or her capacity to understand and

19  meet the needs of the particular child. If the prospective

20  adoptive parent of a minor is a homosexual, the individual

21  assessment shall be conducted by a family court judge who

22  shall determine the qualifications of the prospective parent

23  to provide the environment needed for adoption. No person

24  eligible to adopt under this statute may adopt if that person

25  is a homosexual.

26         Section 2.  This act shall take effect upon becoming a

27  law.
