A bill to be entitled
2An act relating to the practice of interior design;
3amending s. 481.203, F.S.; redefining the term "space
4planning"; amending s. 481.223, F.S.; authorizing retired
5interior designers to use the title "interior designer,
6retired"; prohibiting a person from performing certain
7acts without employing a registered interior designer;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (12) of section 481.203, Florida
13Statutes, is amended to read:
14     481.203  Definitions.--As used in this part:
15     (12)  "Space planning" means the analysis, programming, or
16design of spatial requirements, including preliminary space
17layouts of interior partitions, furniture systems, and final
18planning.
19     Section 2.  Subsection (1) of section 481.223, Florida
20Statutes, is amended to read:
21     481.223  Prohibitions; penalties; injunctive relief.--
22     (1)  A person may not knowingly:
23     (a)  Practice architecture unless the person is an
24architect or a registered architect;
25     (b)  Practice interior design unless the person is a
26registered interior designer unless otherwise exempted herein.
27However, a licensed interior designer who relinquishes or does
28not renew his or her license may use the title "interior
29designer, retired" but may not render any interior design
30services;
31     (c)  Use the name or title "architect" or "registered
32architect," or "interior designer" or "registered interior
33designer," or words to that effect, when the person is not then
34the holder of a valid license issued pursuant to this part;
35     (d)  Present as his or her own the license of another;
36     (e)  Give false or forged evidence to the board or a member
37thereof;
38     (f)  Use or attempt to use an architect or interior
39designer license that has been suspended, revoked, or placed on
40inactive or delinquent status;
41     (g)  Employ unlicensed persons to practice architecture or
42interior design; or
43     (h)  Conceal information relative to violations of this
44part; or.
45     (i)  Use an unlicensed individual to provide engineering or
46architectural services, plumbing or electrical work, landscape
47services, or other work requiring a licensed professional if the
48work is performed for an interior design construction contract
49administered by a registered interior designer or by a
50registered interior designer performing project management or
51oversight as the owner's representative.
52     Section 3.  This act shall take effect July 1, 2006.
