6 | retired"; prohibiting a person from performing certain |
7 | acts without employing a registered interior designer; |
8 | providing an effective date. |

10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. Subsection (12) of section 481.203, Florida |
13 | Statutes, is amended to read: |
14 | 481.203 Definitions.--As used in this part: |
15 | (12) "Space planning" means the analysis, programming, or |
16 | design of spatial requirements, including preliminary space |
17 | layouts of interior partitions, furniture systems, and final |
18 | planning. |
19 | Section 2. Subsection (1) of section 481.223, Florida |
20 | Statutes, is amended to read: |
21 | 481.223 Prohibitions; penalties; injunctive relief.-- |
22 | (1) A person may not knowingly: |
23 | (a) Practice architecture unless the person is an |
24 | architect or a registered architect; |
25 | (b) Practice interior design unless the person is a |
26 | registered interior designer unless otherwise exempted herein. |
27 | However, a licensed interior designer who relinquishes or does |
28 | not renew his or her license may use the title "interior |
29 | designer, retired" but may not render any interior design |
30 | services; |
31 | (c) Use the name or title "architect" or "registered |
32 | architect," or "interior designer" or "registered interior |
33 | designer," or words to that effect, when the person is not then |
34 | the holder of a valid license issued pursuant to this part; |
35 | (d) Present as his or her own the license of another; |
36 | (e) Give false or forged evidence to the board or a member |
37 | thereof; |
38 | (f) Use or attempt to use an architect or interior |
39 | designer license that has been suspended, revoked, or placed on |
40 | inactive or delinquent status; |
41 | (g) Employ unlicensed persons to practice architecture or |
42 | interior design; or |
43 | (h) Conceal information relative to violations of this |
44 | part; or. |
45 | (i) Use an unlicensed individual to provide engineering or |
46 | architectural services, plumbing or electrical work, landscape |
47 | services, or other work requiring a licensed professional if the |
48 | work is performed for an interior design construction contract |
49 | administered by a registered interior designer or by a |
50 | registered interior designer performing project management or |
51 | oversight as the owner's representative. |
52 | Section 3. This act shall take effect July 1, 2006. |
