  1                      A bill to be entitled

  2         An act relating to qualified job-training

  3         organizations; creating s. 288.1171, F.S.;

  4         defining the term "qualified job-training

  5         organization"; providing for the Office of

  6         Tourism, Trade, and Economic Development to

  7         certify qualified job-training organizations;

  8         providing for the distribution of certain funds

  9         to a certified organization; specifying uses of

10         the funds; providing for revocation of

11         certification under certain circumstances;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Section 288.1171, Florida Statutes, is

17  created to read:

18         288.1171  Qualified job-training organizations;

19  certification; duties.--

20         (1)  As used in this section, the term "qualified

21  job-training organization" means an organization that:

22         (a)  Is accredited by the Commission for Accreditation

23  of Rehabilitation Facilities;

24         (b)  Collects Florida state sales tax;

25         (c)  Operates statewide and has more than 100 locations

26  within the state;

27         (d)  Is exempt from income taxation under s. 501(c)3 or

28  s. 501(c)4 of the Internal Revenue Code of 1986, as amended;

29         (e)  Specializes in the retail sale of donated items;

 1         (f)  Provides job training and employment services to

 2  individuals who have workplace disadvantages and disabilities;

 3  and

 4         (g)  Uses a majority of its revenues for job training

 5  and placement programs that create jobs and foster economic

 6  development.

 7         (2)  To be eligible for funding, an organization must

 8  be certified by the Office of Tourism, Trade, and Economic

 9  Development as meeting the criteria in subsection (1). After

10  certification, the Office of Tourism, Trade, and Economic

11  Development may release the funds pursuant to a contract with

12  the qualified job-training organization. The contract must

13  address the performance conditions and sanctions for failure

14  to meet the performance conditions.

15         (3)  A qualified job-training organization that is

16  certified must use the proceeds provided solely to encourage

17  and provide economic development through capital construction,

18  improvements, or the purchase of equipment that will result in

19  expanded employment opportunities.

20         (4)  The failure to use the proceeds as required

21  constitutes grounds for revoking certification.

22         Section 2.  This act shall take effect July 1, 2006.

24          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
25                         Senate Bill 164

27  This committee substitute eliminates the authorization for the
    Auditor General to examine a certified organization's use of
28  funds, eliminates authorization for the Office of Tourism,
    Trade and Economic Development to recover misused funds
29  pursuant to laws and rules governing tax assessment, and
    deletes the appropriation of $3 million from the bill.
