1 A bill to be entitled
2 An act relating to animal health care services;
3 amending s. 474.203, F.S.; providing that ch.
4 474, F.S., relating to veterinary medical
5 practice, does not apply to a part-time worker
6 or an independent contractor who is hired by
7 the owner of an animal or a herd or flock of
8 animals to provide certain services concerning
9 such animal, herd, or flock; providing for
10 retroactive application; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (5) of section 474.203, Florida
16 Statutes, is amended to read:
17 474.203 Exemptions.--This chapter shall not apply to:
18 (5)(a) Any person, or the person's regular employee,
19 administering to the ills or injuries of her or his own
20 animals, including, but not limited to, castration, spaying,
21 and dehorning of herd animals, unless title has been
22 transferred or employment provided for the purpose of
23 circumventing this law. This exemption shall not apply to
24 out-of-state veterinarians practicing temporarily in the
25 state. However, only a veterinarian may immunize or treat an
26 animal for diseases which are communicable to humans and which
27 are of public health significance.
28 (b) A person hired on a part-time or temporary basis,
29 or as an independent contractor, by an owner to assist with
30 herd management and animal husbandry tasks for herd and flock
31 animals, including castration, dehorning, parasite control,

1 and debeaking, or a person hired on a part-time or temporary
2 basis or as an independent contractor by the owner to provide
3 farriery and manual hand floating of teeth on equines.
4 Section 2. This act shall take effect upon becoming a
5 law and applies retroactively to January 1, 2006.

7 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

10 The CS/CS exempts a person hired on a part-time basis or
temporary basis or as an independent contractor by the owner
11 to provide manual hand floating of teeth or farriery of
equines from the provisions of the Florida Veterinary Practice
12 Act, Ch. 474, F.S.
13 The CS/CS also deletes the reference to the term "of an animal
or a herd or flock of animals" from the description of owner.

The CS/CS provides for retroactive application of this act to
15 January 1, 2006.
