  1                      A bill to be entitled

  2         An act relating to accessories to a crime;

  3         amending s. 777.03, F.S.; removing provisions

  4         that exempt certain members of an offender's

  5         family from being charged with the offense of

  6         acting as an accessory after the fact;

  7         providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  This act may be cited as the "Jason A.

12  Gucwa Act."

13         Section 2.  Subsection (1) of section 777.03, Florida

14  Statutes, is amended to read:

15         777.03  Accessory after the fact.--

16         (1)(a)  Any person, except a child younger than 18

17  years of age at the time of the commission of the underlying

18  felony, regardless of the relation to the offender not

19  standing in the relation of husband or wife, parent or

20  grandparent, child or grandchild, brother or sister, by

21  consanguinity or affinity to the offender, who maintains or

22  assists the principal or accessory before the fact, or gives

23  the offender any other aid, knowing that the offender had

24  committed a felony or been accessory thereto before the fact,

25  with intent that the offender avoids or escapes detection,

26  arrest, trial or punishment, is an accessory after the fact.

27         (b)  Any person, regardless of the relation to the

28  offender, who maintains or assists the principal or accessory

29  before the fact, or gives the offender any other aid, knowing

30  that the offender had committed the offense of child abuse,

31  neglect of a child, aggravated child abuse, aggravated

 1  manslaughter of a child under 18 years of age, or murder of a

 2  child under 18 years of age, or had been accessory thereto

 3  before the fact, with the intent that the offender avoids or

 4  escapes detection, arrest, trial, or punishment, is an

 5  accessory after the fact unless the court finds that the

 6  person is a victim of domestic violence.

 7         Section 3.  This act shall take effect upon becoming a

 8  law.
