A bill to be entitled
2An act relating to contractual access and use of
3electronic and information technology for persons with
4disabilities; creating s. 287.1346, F.S.; requiring
5contractors to comply with certain federally mandated
6Internet accessibility requirements for persons with
7disabilities; specifying contract requirements; specifying
8conditions for breach and termination of a contract;
9requiring state agencies to comply with such federal
10requirements under certain circumstances; requiring the
11Department of Management Services to adopt rules;
12providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Section 287.1346, Florida Statutes, is created
17to read:
18     287.1346  Contractual access and use of electronic and
19information technology for persons with disabilities; rules.--
20     (1)  Any private contractor which contracts with an agency
21to sell commodities or services to the state shall comply with
22the provisions of section 508 of the Rehabilitation Act of 1973,
23as amended, 29 U.S.C. s. 794(d). Each contract entered into
24between an agency and a private contractor must contain a
25requirement that the private contractor comply with the
26provisions of section 508 of the Rehabilitation Act of 1973, as
27amended, 29 U.S.C. s. 794(d). Failure by a private contractor to
28comply with such provisions shall be considered a breach of the
29contract and constitutes grounds for revocation of the contract.
30     (2)  Each state agency shall comply with the provisions of
31section 508 of the Rehabilitation Act of 1973, as amended, 29
32U.S.C. s. 794(d), when contracting to purchase commodities or
33services and when conducting any agency activities relating to
34access and use of electronic information and technology.
35     (3)  Pursuant to chapter 120, the department shall adopt
36any rules necessary to administer, implement, and enforce this
37section.
38     Section 2.  This act shall take effect July 1, 2006.
