8 | conditions for breach and termination of a contract; |
9 | requiring state agencies to comply with such federal |
10 | requirements under certain circumstances; requiring the |
11 | Department of Management Services to adopt rules; |
12 | providing an effective date. |

14 | Be It Enacted by the Legislature of the State of Florida: |

16 | Section 1. Section 287.1346, Florida Statutes, is created |
17 | to read: |
18 | 287.1346 Contractual access and use of electronic and |
19 | information technology for persons with disabilities; rules.-- |
20 | (1) Any private contractor which contracts with an agency |
21 | to sell commodities or services to the state shall comply with |
22 | the provisions of section 508 of the Rehabilitation Act of 1973, |
23 | as amended, 29 U.S.C. s. 794(d). Each contract entered into |
24 | between an agency and a private contractor must contain a |
25 | requirement that the private contractor comply with the |
26 | provisions of section 508 of the Rehabilitation Act of 1973, as |
27 | amended, 29 U.S.C. s. 794(d). Failure by a private contractor to |
28 | comply with such provisions shall be considered a breach of the |
29 | contract and constitutes grounds for revocation of the contract. |
30 | (2) Each state agency shall comply with the provisions of |
31 | section 508 of the Rehabilitation Act of 1973, as amended, 29 |
32 | U.S.C. s. 794(d), when contracting to purchase commodities or |
33 | services and when conducting any agency activities relating to |
34 | access and use of electronic information and technology. |
35 | (3) Pursuant to chapter 120, the department shall adopt |
36 | any rules necessary to administer, implement, and enforce this |
37 | section. |
38 | Section 2. This act shall take effect July 1, 2006. |
